Association of the Blind letter to the government: You are discriminating against us, you have transferred responsibilities to the local government

The Albanian Association of the Blind has sent a letter to the government, specifically to the Minister of Health Albana Koçiu, as well as to several embassies in our country.

The association expresses that they feel outraged about the situation of blind people in Albania.

This association declares that it has been forgotten and that the Albanian state has passed its responsibilities to local governments and non-profit organizations.

OPEN LETTER:

Dear Madam Minister,

With this letter, the National Council of the Albanian Association of the Blind expresses its indignation and deep concern for the total abandonment of the state towards blind people in Albania. Your policies have led to systematic discrimination, openly violating the Constitution and the government's legal obligations to guarantee special services that are vital for the blind.

For years, the government has eliminated any special services for the blind, denied legally guaranteed rights, and left previously functional services without funding. Blind people in Albania do not benefit from any specific services that guarantee them an independent and dignified life.

The Constitution clearly states that all citizens are equal before the law and that the state has the obligation to provide direct support to the most vulnerable categories. Law No. 93/2014 “On the Inclusion and Accessibility of Persons with Disabilities” reinforces this obligation, clearly defining the state’s responsibilities to guarantee specialized services for persons with disabilities, including the blind.

Article 5, point 2, states: “State policies support persons with disabilities to have access to all spheres of life.”

Article 11 of the same law states: “The needs for assistance and support are covered by the State Budget, and the funds are planned by the responsible ministry in coordination with the line ministries.”

Instead of implementing this legal obligation, you have chosen to eliminate all forms of state support and shift responsibilities to local governments and various non-profit organizations. This is manipulation and a deliberate avoidance of government responsibility.

Dear Madam Minister,

What is happening is not simply a lack of attention, it is institutional discrimination and a pure act of negligence towards a category of citizens who need real support.

The Albanian state has transferred responsibility for service delivery to municipalities, justifying its inaction by the fact that funds for special services will be managed by the Social Fund. This is a political deception and a bureaucratic scheme that does nothing but distance the state from its constitutional responsibilities.

Nëpërmjet Ligjit nr. 93/2014, Ligjit nr. 121/2016 dhe akteve të tjera nënligjore, qeveria juaj ka kapur plotësisht sistemin e shërbimeve sociale, duke krijuar një monopol të organizatave të caktuara për personat me aftësi të kufizuara. Në pikat 7 dhe 8 të nenit 3 të ligjit 93/2014 është përcaktuar se shërbimet për personat me aftësi të kufizuara do të ofrohen nga Organizatat për Personat me Aftësi të Kufizuara.

Nëse analizojmë plotësisht Ligjin nr. 93/2014, Ligjin nr. 121/2016 dhe aktet e tjera nënligjore, është krijuar një bazë ligjore e konsoliduar, sipas së cilës OJQ-të për personat me aftësi të kufizuara kanë hapësirën e plotë për të qenë aktorë përcaktues në ofrimin dhe financimin e shërbimeve. të cilat kanë përfituar financime të vazhdueshme, ndërsa ne, si përfaqësues të ligjshëm të të verbërve, jemi përjashtuar plotësisht nga vendimmarrja dhe financimi.

Ky nuk është vetëm një diskriminim i hapur, por edhe një skemë klienteliste, që i ka kthyer shërbimet për personat me aftësi të kufizuara në një mjet biznesi për disa grupe të interesit.

Kjo qasje ka shkaktuar kolaps total të shërbimeve për të verbërit. Në asnjë qark të vendit nuk ofrohet asnjë shërbim i specializuar për të verbërit, ndonëse ligjet i parashikojnë ato qartë.

Pse Qendra Kombëtare e Rehabilitimit të të Verbërve (QKRV) nuk mund të ofrojë shërbimet përmes Fondit Social?

1. QKRV është institucion kombëtar dhe nuk mund të financohet përmes mekanizmave vendorë, të cilët varen nga vullneti i pushtetit lokal dhe jo nga një strategji e unifikuar shtetërore.

2. Fondi Social nuk garanton financim të qëndrueshëm, por është një mekanizëm konkurues që krijon pasiguri dhe dështime sistematike. Shërbimet e posaçme nuk mund të mbahen në këmbë nga financime sporadike dhe me procedura të tejzgjatura burokratike.

3. Njësitë vendore nuk kanë kapacitetet, burimet njerëzore dhe ekspertizën për të ofruar shërbimet e specializuara për të verbërit. Delegimi i këtyre shërbimeve tek bashkitë është një veprim i qëllimshëm për t’i shpëtuar përgjegjësisë shtetërore.

4. Çdo qark nuk mund të marrë shërbimet te QKRV, sepse nuk ka asnjë strukturë financimi të dedikuar për këtë institucion, duke e lënë atë jashtë funksionit dhe të paaftë për të kryer detyrën e tij.

E nderuar znj. Ministre,

Në këtë situatë këshilli kombëtar i SHVSH kërkon që ju të ndërmerrni hapa të menjëhershëm për të kthyer shërbimet e posaçme në financim të drejtpërdrejtë nga Buxheti i Shtetit.

Duhet të respektohet kuadri ligjor që përfshin:

• Ligjin nr. 8098, datë 28.3.1996 o“Për Statusin e të Verbërit”

• Vendimin nr. 277 të Këshillit të Ministrave, datë 18.06.1997

• Vendimin nr. 643 për financimin e shërbimeve të posaçme për të verbërit, datë 30.09.2004

• Udhëzimin nr. 10, datë 16.05.2005, të Ministrit të Financave për procedurat e pagesave për shërbimet e posaçme

If your ministry does not reflect and restore direct funding for services for the blind, we will be forced to pursue all forms of civil resistance, including protests, public denunciations, and legal actions against the responsible institutions.

We can no longer accept procrastination, manipulation, and empty excuses. The blind people of Albania are not second-class citizens and we will not allow the state to ignore us any longer.

This is our final call for reflection and immediate action.
