The new draft of the Criminal Code, proposed by the Ministry of Justice, is sparking public debate among lawyers and institutional actors. Among the most critical voices against this legal draft is lawyer Jordan Daci, who has publicly declared that, if it is approved without changes, he will leave Albania, describing the project as a threat to fundamental freedoms.

"If this code is approved as it is, I, the first one, will no longer live in this country. You should not live either, no one should live, because as soon as you move your foot, we will be in prison. Anyone, whenever and however they want, can put someone in prison. These provisions are so subjective, " Daci said on Klan News.

The lawyer emphasized that he was also part of the consultative rounds in the early stages of drafting the draft, but many of the observations made by the experts were not taken into account by the relevant authorities.

"I actually participated in a consultation a year ago, in the capacity of dean. And I have been familiar with part of this draft since last year, at a roundtable where the president of the Chamber and several others also participated. Some remarks were made, which were not even taken into account, even though they were very friendly or very principled remarks. I think that the publication of this draft by the Ministry of Justice is hasty and I greatly welcome the very serious and professional stance of the Prosecutor General, but not only that, but also of the president of the Chamber, Maks Haxhia." - said Daci.

He raised concerns that many of the articles are "at the level of legal error," citing absurd cases such as imprisonment for failure to pay fees or for forgetting to have a vehicle inspected.

"If you were dealing with articles, there were things to put your hands on your head and say: 'Excuse me, are these lawyers, or what the hell are they?' But I'm dealing with very principled things. First of all, the Criminal Code does not follow the basic principles of criminal law. Because if this Code is approved, all lawyers will have to go back to school, because they have to learn things differently from how they were educated.

On the other hand, there are articles that are truly at the level of human and legal error, such as the impact on the independence of the court, unreasonable fees, not going to court and going to jail, or forgetting to do the car inspection and going to jail. This Code contradicts the principles of the EU.
Here, not only freedom of expression is limited, but all freedoms are limited ,” the lawyer emphasized.
