With the new changes in the Doctors' Order, measures ranging from warnings, suspension of medical services, fines up to 1 million ALL and up to the removal of the doctor's license are foreseen.
The measures taken will serve as a regulator in the exercise of the profession of doctors who work in parallel both in the state and in private hospitals, without affecting their professional activity.
The new measures foresee that the doctor "should not work in the non-public health system more than 30 percent of the monthly hours that he works in the public health system".
One of the points for which doctors in public hospitals are clearly requested is that the latter do not refer their patients to private hospitals.
"A member of the Order of Doctors, who wants to practice the profession of a doctor in a non-public health institution, must make a request to the head of the public health institution where he is employed".
In the sense of this law, the term "practice of the profession of a doctor" includes the opening, participation, as well as employment in a non-public health institution", it is stated in the changes carried out in the Doctor's Order published in the Official Gazette.
In the new changes, it is foreseen that doctors who practice their profession in public hospitals that have benefited from the status of autonomy cannot work in private hospitals.
"Members of the Order of Doctors, who are employed in a public health institution, which has benefited from the status of financial hospital autonomy..." , is further emphasized in the changes on the new order of doctors.
Likewise, the Normative Act foresees disciplinary measures in cases where it is proven that a member of the Medical Order has committed a violation of ethics, the Code of Medical Ethics and Deontology or has made technical errors.
They start with notices, suspension to perform certain medical services, for a period of 6 months to 3 years, suspension of the license to practice the profession of a doctor in its entirety, for a period of 6 months to 5 years , a fine ranging from 100,000 Lek to 1 million Lek up to the removal of the license to practice the profession of a doctor.
