Electoral crimes, many complaints, few punishments!

On Thursday morning (8 May), a surprise visit by SPAK Chief Prosecutor Altin Dumani to Shkodra “sent into motion” BKH investigators to conduct  a rapid action in implementation of the decision of the GJKKO, to control vehicles and other premises owned or used by six citizens. Lists of voters’ names, amounts of money and euros, vehicles and mobile phones were seized for the benefit of the open proceedings.

Controls

The targets of the checks and investigations were representatives or citizens engaged with the political entity Social Democratic Party, led by Tom Doshi. A few hours later, PSD officially reacted by admitting that only one check was carried out in the premises of the apartment and business of the PSD chairman of Malësia e Madhe, but according to it, no illegal items were found. There were no arrests in flagrante delicto or detention on suspicion of vote buying, with the exception of a single case in Lushnje, where a citizen was arrested on suspicion of giving 500 euros in exchange for a vote for a political entity, (officially the PD was said), but the case is still in the investigation phase.

Proceedings

While SPAK has been limited to only 35 criminal proceedings but still without conclusion, the Prosecutor's Offices of General Jurisdiction (District Prosecutor's Offices) have also registered 54 criminal reports, of which 23 have been registered.

CEC

While criminal investigations do not have a positive balance in arrests in flagrante delicto, or the escorting of persons suspected of electoral crimes, the CEC has received a high number of complaints from political entities, NGOs, or denunciations from citizens, but has not imposed administrative measures on any entity or individual involved in violations of the Electoral Code.

Investigations by SPAK

On January 25 of this year, the Special Prosecution Office announced at a press conference the platform for investigating electoral crimes. SPAK prosecutors and agents of the National Bureau of Investigation were deployed in 12 regions of the country in implementation of the plan of measures on the strategy for investigating electoral crimes. As of Thursday (May 8), SPAK announced that it had registered 35 criminal proceedings. Despite numerous political accusations and suspicions of vote buying and illegal use of public administration in elections, the number of open criminal cases remains small. The Special Prosecution Office against Corruption and Organized Crime announced that 123 indictments have been administered, of which 35 have been registered as criminal proceedings and have passed into the investigation phase.

Refuar të dhenave zyrtare, SPAK është “furnizuar” nga Policia e Shtetit me 20 referime, ndërsa vetë Prokuroria Speciale ka nisur kryesisht 8 çështje panele, tre denocime nga individë të ndryshëm, dy çështje të kaluara për kompetencë nga prokurorët e rretheve dhe vetëm 2 janë nga subjektet politike. Për Faktoje.al,  SPAK njoftoi se, “për periudhën janar 2025 – 26.04.2025, në platformën online kanë ardhur gjithsej 26 materiale kallëzuese”.

Prokuroritë e rretheve

Ndërsa SPAK ka mbuluar një pjesë të hetimeve, edhe prokuroritë e rretheve nuk kanë mbetur pas në denocime të ndryshme. Sipas burimeve zyrtare nga Prokuroria e Përgjithshme, përgjatë fushatës zgjedhore, deri më datë 9 maj janë regjistruar gjithsej 54 kallëzime për vepra penale që lidhen me procesin zgjedhor. Nga këto referime janë parë element të krimeve zgjdhore në 23 procedime penale në disa prej prokurorive të vendit. Por edhe këtu Policia e Shtetit mban numrin më të madh të procedimeve të referuara për hetime të mëtejshme, në lidhje me dyshimet për krime zgjedhore.

Veprat penale

Në klasifikimin e veprave penale dominon akuza që i referohen neneve 228 dhe 228/a. “Ofrimi ose dhënia e të hollave apo të mirave materiale, bërja e premtimeve për vende pune ose për favorizime të tjera në cilëndo formë, me qëllim që të marrë firmën për paraqitjen e kandidatit, për të votuar në një mënyrë të caktuar apo për të marrë pjesë ose jo në votime” dhe “Detyrimi për pjesëmarrje në veprimtari politike Detyrimi i shtetasve nën varësi administrative, kundër vullnetit të tyre apo nën kanosjen e përdorimit të masave administrative, për të marrë pjesë në veprimtari zgjedhore të një subjekti zgjedhor”.

Hetimet administrative

Në Komisionin Qëndror Zgjedhor numri i denocimeve nga subjekte politike, Organizata Jo Qeveritare, institucione dhe qytetarë, është relativisht i lartë. Denocimet lidhen kryesisht mbi dyshimet që subjekte të ndryshme zgjedhore, apo kandidatë për deputetë kanë shkelur Kodin Zgjedhor, që në raste të tilla masat janë administrative (gjobë). “Pranë Komisionit Qendror të Zgjedhjeve, janë depozituar 159 denoncime, për 368 subjekte, të përcjella për shkelje të parashikuara në dispozitat e neneve 91 dhe 92, të Kodit Zgjedhor si dhe të vendimit nr. 9, datë 29.12.2020, të Komisionit Rregullator”- thotë për Faktoje.al burimet zyrtare të KQZ-së. Po sipas KQZ, për 37 denoncime është vendosur mosfillimi i procedurës administrative, për shkak se informacioni apo të dhënat e treguara nuk krijonin një bazë të mjaftueshme për të hetuar administrativisht shkeljet e mundshme. “Për 122 denoncime ka nisur fillimi i procedurës administrative, nga të cilat: 71 denoncime ka përfunduar hetimi administrativ; 51 denoncime janë ende në hetim administrative”, thotë KQZ.

Masat

However, administrative measures have been lacking so far. "The Central Election Commission has sent a request for each subject of the administrative investigation to file claims on the alleged violation by the complainant. We are still in the phase of administering the claims and reviewing each of them," says the CEC./ Faktoje.al
