Additional floors built without permits in Tirana, the Prosecution requests

The Tirana Prosecution has requested the security measure "Arrest in prison" for four people suspected of illegal construction in the capital, after the discovery of serious violations in a building.

According to the investigation, the suspects have exceeded the parameters of the construction permit by adding unauthorized floors and conducting informal sales to avoid fiscal obligations, while the prosecution also raises suspicions of inaction by the structures responsible for inspecting the territory.

Announcement: 

The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, issued the security measure 'Arrest in prison' for four citizens Mirsim Jella, Fiqiri Lika, Ferdinand Štēmbari and Adriatik Štēmbari, suspected of the criminal offense 'Illegal construction', provided for by article 199/a/4 and 25 of the Criminal Code.

From the investigations into criminal proceedings no. 3193 dated 08.05.2026, it resulted that these citizens have exceeded the parameters of the construction permit, in a construction on "Llukë Kaçaj" Street, specifically behind "American Hospital 2", and are carrying out construction works outside the conditions approved in the relevant project and have exercised activity in violation of the legislation in force, exceeding the parameters of the construction permit and making sales informally, with the aim of avoiding fiscal obligations.

From the analysis of the circumstances of the fact and the duration of the construction activity, it results that the object in question was built over a period of several years, during which it is suspected that, despite the fact that construction works were carried out in violation of the construction permit, the violations were continuous and visible on the ground. However, it does not appear that administrative or punitive measures have been taken by the responsible structures of the IMT and IKMT. Under these conditions, a reasonable suspicion arises that employees or officials of the territory inspection structures, who had the legal obligation to control, identify and stop these violations, did not act in accordance with the law.
From the technical-legal documentation, it results that the construction permit for another building was for 2 floors underground and 9 floors above ground. From the inspection of the object under construction, it results that two additional floors were built in height, so the object is not 9 floors above ground, but 11 floors above ground. Referring to data administered by IMT Bashikia Tirana, 2550 m2 more than foreseen in the building permit (10th and 11th floors) were built, exceeding the building permit.

From the investigation and the data obtained, it is proven that citizens MJ, FL, F. Sh. and A. Sh. have consumed the respective elements for the configuration of the criminal offense "Illegal construction" provided for by article 199/a/4 and 25 of the Criminal Code.

Under these circumstances, against citizens MJ, F.Sh., FL and A.Sh, there is a need to impose the coercive personal security measure 'Arrest in prison', since there are legal conditions and criteria for imposing personal security measures provided for by articles 228, 229, 230 of the Criminal Procedure Code. Specifically, there is a reasonable suspicion based on evidence that they have committed the criminal offense "Illegal construction", provided for by article 199/a/4 and 25 of the Criminal Code, there are no grounds for impunity or expungement of the criminal offense and conviction.
