Violation of equality in tenders, SPAK sends Mayor Erion Isai and 11 others for trial

The Special Prosecution Office has completed the investigations and sent for trial to the Special Court of First Instance a criminal proceeding related to several procurement procedures conducted by the Municipality of Kolonjë and the Albanian Road Authority (ARRSH).

Among the defendants are the mayor of Kolonjë, Erion Isai, as well as former senior officials of the ARA and other public and private employees, accused of offenses related to abuse of office, violation of equality in tenders, and falsification of documents.

According to SPAK, investigations have revealed that in several procurement procedures, including the project "Construction of the Korçë-Ersekë road, Lot 2", irregularities were found in the drafting of documentation, the determination of the limit fund and the conduct of the competition.

The prosecution claims that in some cases the legal procedure for determining the fund was not followed and that the project documentation was presented irregularly, while in one case the procurement fund was increased by hundreds of millions of lek, also causing economic damage to the state budget.

The Special Prosecution Office against Corruption and Organized Crime completed the investigations and has sent to the Special Court of First Instance the request for the trial of criminal proceedings no. 280/1 of 2020, against the defendants:

Erion Isai, acting as Mayor of the Municipality of Kolonjë, accused of committing the criminal offenses of "Abuse of office", in collaboration, "Violation of equality of participants in tenders or public auctions", in collaboration, provided for by articles 248 and 25, 258 and 25 of the Criminal Code;

Eljona Mydini, former deputy mayor of the Municipality of Kolonjë, accused of committing the criminal offense of "Abuse of office", in collaboration, provided for by article 248 and 25 of the Criminal Code;

Ergys Verdho, former General Director of the Albanian Road Authority, accused of committing the criminal offense of "Abuse of office", in collaboration, provided for by article 248 and 25 of the Criminal Code;

Erald Elezi, former Director of the Directorate of Strategic Planning and Operations, at the Albanian Road Authority, accused of committing the criminal offense of "Abuse of office", in collaboration, provided for by article 248 and 25 of the Criminal Code;

Genti Raça, with the duty of head of the preventive sector at the Albanian Road Authority, accused of committing the criminal offense of "Abuse of office", in collaboration, provided for by article 248 and 25 of the Criminal Code;

Donika Shehu, former high-level specialist at the Albanian Road Authority, accused of committing the criminal offense of "Abuse of office", in collaboration, provided for by article 248 and 25 of the Criminal Code;

Klarita Konomi, former high-level specialist at the Albanian Road Authority, accused of committing the criminal offense of "Violation of equality of participants in public tenders or auctions", in collaboration, provided for by Article 258, 25 of the Criminal Code;

Nikollaq Mihali, with the duty of high-level specialist at the Albanian Road Authority, accused of committing the criminal offense of "Violation of equality of participants in tenders or public auctions", in collaboration, provided for by article 258, 25 of the Criminal Code;

Erdit Salillari, with the duty of head of the foreign project drafting sector at the Albanian Road Authority, accused of committing the criminal offense of "Violation of equality of participants in tenders or public auctions", in collaboration, provided for by article 258, 25 of the Criminal Code;

Erjon Cenko, Engjëll Dine, Ermal Zylfo, employees of the Municipality of Kolonjë, accused of committing the criminal offenses of "Forgery of documents, in collaboration", "Violation of equality of participants in tenders or public auctions", in collaboration, provided for by articles 186/2, 258 and 25 of the Criminal Code;

Armand Tafil, Muharrem Tartari, Shpëtim Liço, employees of the Municipality of Kolonjë, accused of committing the criminal offense of "Violation of equality of participants in public tenders or auctions", in collaboration, provided for by Article 258, 25 of the Criminal Code;

Entela Çano, with the position of administrator at the company A& E Enginieering" sh.pk, accused of committing the criminal offense of "Forgery of documents", in collaboration, provided for by Article 186/2 of the Criminal Code.

From the conduct of investigative actions, the evidence administered resulted in criminal facts for the responsible persons of the contracting authority and other state institutions, interacting in several procurement procedures, developed by the Albanian Road Authority and the Municipality of Kolonjë.

1. In relation to the procurement procedure with the object "Construction of the Korçë Ersekë road, Lot 2 (part one)", with a limit fund of 2,879,999,858.89 (two billion eight hundred seventy-nine million nine hundred ninety-nine thousand eight hundred fifty and eight point eighty-nine) lek including VAT, developed by the Albanian Road Authority on 24.09.2020, it has resulted that:

In relation to the project presented as an initiative of the Municipality of Kolonjë, within the framework of the procedure followed for "Design service in the form of donation" with the object "Construction of Korçë-Ersekë road, Lot 2", from the investigative actions and the evidence administered, it was found that the Municipality of Kolonjë did not have design documentation prepared by it for this object, although there are official correspondences with the Albanian Road Authority in which the opposite is stated.

Nga provat e administruara, mbështetur edhe nga eskpertimi grafik i shkrimit dhe nënshkrimit të dokumentit, ka rezultuar se grupi i punës së Bashkisë Kolonjë, i përbërë nga shtetasit Erjon Cenko, Engjëll Dine, në bashkëpunim me personin që ka dhuruar projektin, shtetasen Entela Çano, administratore e shoqërise “A& E Enginieering”sh.p.k, kanë falsifikuar procesverbalin e marrjes në dorëzim të projektit nga Bashkia Kolonjë, ndërkohë që rezulton se nuk ka pasur projekt.

Sa i takon, përcaktimit të fondit limit për procedurën e prokurimit, nga ana e shtetasve Ergys Verdho, në cilësinë e titullarit të autoritetit kontraktor dhe personave të tjerë përgjegjës të Autoritetit Rrugor Shqiptar, shtetasit  Erald Elezi, Genti Raça dhe Donikë Shehu, nuk rezulton të jetë ndjekur rruga ligjore për përcaktimin e fondit limit.

Në kohën e hartimit të preventivit përfundimtar, të përgatitur nga ana e shtetasve Erald Elezi, Genti Raça, Donikë Shehu, dokument i miratuar edhe nga Drejtori i Përgjithshëm i Autoritetit Rrugor Shqiptar, shtetasi Ergys Verdho, nuk rezulton të ketë pasur projekt të hartuar dhe propozuar nga Bashkia Kolonjë, siç është paraqitur si dokumentacion i formalizuar nga Bashkia Kolonjë.

Përcaktimi i fondit limit nga ana e grupit të punës, personat përgjegjës të Autoritetit Rrugor Shqiptar, shtetasit Erald Elezi, Genti Raça dhe Donikë Shehu, është bërë mbi bazën e të dhënave të përgatitura dhe të paraqitura dorazi nga vetë personi i interesuar, shtetësja, Entela Çano, administratorja e shoqërisë “A & E Engineering” sh.p.k, e cila që ka fituar më pas kontratën e mbikëqyrjes së zbatimit të punimeve për këtë objekt, ndërtimi i rrugës Korçë-Ersekë, loti i 2 (pjesa e parë).

Në përgatitjen e preventivit që ka shërbyer edhe për përcaktimin e fondit limit të autoritetit kontraktor, nga ana e shtetasve  Ergys Verdho, në cilësinë e Drejtorit të Përgjithshëm të Autoritetit Rrugor Shqiptar dhe personave përgjegjës të tjerë, shtetasit Erald Elezi, Genti Raça dhe Donikë Shehu, është vepruar në kundërshtim me ligjin nr.162/2020 “Për prokurimin publik”, VKM nr.914, datë 29.12.2014 “Për miratimin e rregullave të prokurimit publik”, i ndryshuar, ligjin nr. 10296, datë 8.7.2010, “Për menaxhimin financiar dhe kontrollin”, të ndryshuar, ligjin nr.10164, datë 15.10.2009 “Për Autoritetin Rrugor Shqiptar”, VKM nr.276, datë 16.5.2018 “Për miratimin e organizimit, të strukturës, organikës dhe statutit të Autoritetit Rrugor Shqiptar”.

Nga provat e administruara, mbështetur edhe nga ekspertimi teknik vlerësues dhe kontabël, ka rezultuar se fondi i përcaktuar nga autoriteti kontraktor për këtë procedurë prokurimi është fryrë në vlerën 590,213,874(pesëqind e nëntëdhjetë milion e dyqind e trembëdhjetë mijë e tetëqind e shtatëdhjetë e katër) lekë, që përbën edhe dëm ekonomik të shkaktuar shtetit.

2.Procedura e prokurimit me objekt: “Supervizim i punimeve për ndërtimin e rrugës Korçë-Ersekë, loti i 2 (pjesa e parë)”, me fond limit  22,704,145 (njëzet e dy milion e shtatëqind e katër mijë e njëqind e dyzet e pesë) lekë me tvsh, zhvilluar nga Autoriteti Rrugor Shqiptar në datën 14.10.2020,  ka rezultuar se:

Erdit Salillari, Klarita Konomi, Niko Mihali, nën cilësinë e anëtarëve të komisionit të vlerësimit të ofertave kanë vepruar në kundërshtim me ligjin nr. 9643, datë 20.11.2006 “Për prokurimin publik”, i ndryshuar dhe VKM nr.914, datë 29.12.2014 “Për miratimin e rregullave të prokurimit publik”, i ndryshuar, duke krijuar avantazhe dhe privilegje të padrejta për shoqërinë e shtetases Entela Çano, “A&E Engineering” sh.p.k. 

3.Procedura e prokurimit me objekt: “Mbikëqyrje Punimesh Ndërtim i Ujësjellësit Ersekë dhe të disa fshtarave Faza e dytë nga burimet e Kozelit”, me fond limit 4,623,021.7 lekë me tvsh, zhvilluar nga Bashkia Kolonjë, zhvilluar në datën 06.10.2020, ka rezultuar se:

Në lidhje me përllogaritjen e fondit limit dhe hartimin e specifikimeve teknike, shtetasit Muharem Tartari, Engjëll Dine, Ermal Zylfo, nën cilësinë e anëtarëve të komisionit të përllogaritjes së fondit limit dhe hartimin e specifikimeve teknike, në bashkëpunim me titullarin e autoritetit kontraktor, shtetasin Erion Isai, kanë vepruar në kundërshtim me ligjin nr.162/2020 “Për prokurimin publik”, si dhe VKM nr. 914, datë 29.12.2014 “Për miratimin e rregullave të prokurimit publik”, i ndryshuar, me qëllim favorizimin dhe krijimin e privilegjeve të padrejta për shoqërinë fituese të kësaj procedure prokurimi, shoqëria “A&E Engineering” sh.p.k.

Anëtarët e komisionit të përllogaritjes së fondit limit dhe hartimin e specifikimeve teknike,  shtetasit Muharem Tartari, Engjëll Dine, Ermal Zylfo, në përllogaritjen e fondit janë bazuar pa kryer një studim real të tregut, duke u mbështetur në oferta fiktive të përgatitura nga vetë shoqëria fituese e kësaj procedure prokurimi, shoqëria “A&E Engineering” sh.p.k. Si dhe specifikimet teknike janë përgatitur  nga administratorja e shoqërisë “A&E Engineering” sh.p.k.,shtetasja Entela Çano.

Në lidhje me hartimin e dokumenteve standarde të tenderit, anëtarët e njësisë së prokurimit, shtetasit Armand Tafil, Erjon Cenko, Shpëtim Liço, në bashkëpunim me titullarin e autoritetit kontraktor, shtetasin Erion Isai, kanë vepruar në kundërshtim me ligjin nr.162/2020 “Për prokurimin publik”, si dhe VKM nr. 914, datë 29.12.2014 “Për miratimin e rregullave të prokurimit publik” i ndryshuar, me qëllim favorizimin dhe krijimin e privilegjeve të padrejta për shoqërinë fituese të kësaj procedure prokurimi, shoqëria “A&E Engineering” sh.p.k.

The members of the procurement unit, citizens Armand Tafil, Erjon Cenko, Shpëtim Liço, in cooperation with the head of the contracting authority, citizen Erion Isai, have approved the standard tender documents by establishing criteria determined by the winning company of this procurement procedure, the company "A&E Engineering" sh.pk.
