"Spies" within institutions are not functioning, only 2 cases reported

The High Inspectorate for Declaration and Control of Assets and Conflict of Interest (HIDAKKI) reports that during 2025 it continued to monitor the implementation of the law on whistleblower protection and whistleblowers, expanding control in both the public and private sectors.

According to the report, there are currently 185 whistleblowing units operating in the public sector, established in institutions with over 80 employees. Meanwhile, in the private sector, there are 526 whistleblowing units, established in organizations with more than 100 employees.

The report highlights that administrative measures with fines were applied to organizations that did not comply with the obligation to establish and report responsible units. In total, for the period 2016–2025, 237 fines were imposed on organizations that did not establish responsible signaling units, while during 2025 only 8 administrative measures were applied.

According to the data, HIDAKCI has received 174 annual reports from the public sector, while 157 units have submitted them within the legal deadlines. The analysis of these reports shows that only two institutions have registered whistleblowing cases during 2025. One case was reported by the State Technical Industrial Inspectorate, where a whistleblowing was handled, but the administrative investigation did not find any legal violations. The other case was registered by the Municipality of Lushnje, where the responsible unit decided not to initiate an administrative investigation.

In the private sector, 277 whistleblowing reports were administered, while 233 responsible units submitted their reports within the legal deadlines. The report emphasizes that only one private entity reported concrete whistleblowing cases during 2025. According to the HIDACCI, the company “Sisal Albania” sh.pk has reported 13 whistleblowing cases, where for 6 of them the administrative investigation has been completed, while 7 cases are still under investigation.

Regarding the external reporting mechanism, HIDAACCI has registered and processed a total of 11 whistleblowing cases and 8 requests for protection from retaliation during 2025. According to the report, the majority of cases are related to public administration institutions at central and local levels, but also to higher education institutions and independent institutions.

The subject of the reports includes suspicions of conflict of interest, irregularities in the exercise of public functions, violations of public procurement procedures and possible cases of falsification of official documents. Some of the cases are also related to employment relations and allegations of unfair treatment of employees or the need for protection from retaliation.

The report highlights that administrative measures with fines have been imposed for procedures that have resulted in violations of the legal framework. In total, 13 administrative measures have been taken for the period 2017–2025 within the framework of investigations conducted on whistleblowing and protection requests.

In some cases, after administrative investigations, competent institutions such as the Supreme State Audit Office, State Police structures and heads of public institutions have been notified to take further measures, however, it did not result in any acts of retaliation directly or indirectly related to the whistleblowers. /ekofin.al
