Appeal removes Ergys Agas' apartment from seizure

The Special Court of Appeal decided on Tuesday, June 2, to dismiss part of SPAK's requests for the seizure of assets of those investigated in the AKSHI affair and individuals and companies linked to them. A month ago, the First Instance Court accepted SPAK's request for the seizure of assets worth over 40 million euros, as part of the criminal proceedings against the former director of AKSHI, Mirlinda Karçanaj, and businessmen Ergys Agasi and Ermal Beqiraj.

Judge Florjan Kalaja ruled on Tuesday regarding the request made by Karçanaj, Andis Papa, Ermal Beqiri, Arjola Koromani, Xhenila Tamizi, as well as the companies First sh.pk, Fortis Beton sh.pk, Horizon sh.pk and Soft & Solution sh.pk, ordering the lifting of the seizures for some of the blocked assets, which in total amount to over 7 million euros.

The Court partially reversed the decision of the First Instance, lifting the seizure of an apartment in the name of Ergys Agas, located in a 10-story building in Durrës. The decision of the First Instance regarding the assets of the suspect Gëzim Hoxha was partially reversed, rejecting SPAK's request for the seizure of the assets of the company First sh.pk in the amount of 123.6 million lek. The seizure was also lifted from the assets of the suspect Andis Papa, specifically the assets of the subject Fastech sh.pk, in the amount of 410.5 million lek and of the company Fast&Fresh sh.pk, in the amount of 94.4 million lek. It was also decided to lift the seizure from the assets of the company Albascan sh.pk, in the amount of 100 million lek, half of whose shares are owned by the suspect Elision Jorgjis.

The appeal has approved the remaining part of the decision of the Special Court of First Instance, regarding the assets seized as part of the property investigation conducted against those investigated in the AKSH affair.

The seized assets include apartments and land in Tirana, Durrës, Vlorë and Kavajë, villas and large properties in the Petrela area, luxury vehicles such as a Land Rover Defender and a Volkswagen Tiguan, a yacht, as well as several commercial entities. Bank accounts and significant amounts of money in banks and private companies have also been seized.

The majority of the assets turn out to be in the name of businessman Ergys Agasi, who owns several properties and buildings in the Petrela area, as well as apartments and other properties in Tirana, Durrës and Vlora. Meanwhile, other persons under investigation have also had immovable properties, companies, vehicles and large sums of money in bank accounts or commercial entities seized, some of which were released by the Court of Appeal on Tuesday.

Three apartments have been seized from investigator Mirlinda Karçanaj alone – two in Tirana and one in Qerret, as well as 1,500 m² of land in Sauk, bank accounts and a vehicle. Before Karçanaj's assets were seized, Prime Minister Rama publicly defended her, stating that she lived in a rented house.

The Special Prosecution Office accuses Ergys Agasi and Ermal Beqiraj of creating a structured criminal group to manipulate tenders of the National Agency for the Information Society, including through violence and hostage-taking. Agasi and Beqiraj escaped arrest, while the former director of the AKSHI was initially placed under "house arrest", but this measure was lifted by the Supreme Court about a month ago. Reporter.al
