The government increases the property tax, doubling it for apartments and up to 25% for businesses

The government is reinstating the proposal to double the housing tax rate for citizens and increase the tax rate for buildings used for commercial activity by up to 25%.
The proposed tax rate for both houses and shops is at the same levels as those proposed in the 2023 draft. The taxation formula also remains the same, where it is envisaged that a non-taxable value will be deducted from the first house. But from the 4.5 million lek that was proposed in 2023 for Tirana, in the new draft law the non-taxable value increases by 3.9 million lek. The maximum non-taxable threshold for the first house is proposed at 8.4 million lek.
"Article 8 establishes a deduction from the value of the first residence of all individuals, in an amount equal to 50% of the value of the first residence, but in any case, no more than the maximum deduction threshold determined for 7 categories of municipalities in Annex 1 of the draft law (see table below).
The maximum threshold for the deduction in the municipality of Tirana, which has the highest housing values in the country, is 8,400,000 lek, for municipalities in the second category it is 4,750,000 lek, for municipalities in the third category it is 3,550,000 lek, for municipalities in the fourth category it is 2,800,000 lek, for municipalities in the fifth category it is 2,050,000 lek, for municipalities in the sixth category it is 1,450,000 lek and for municipalities in the seventh category it is 750,000 lek", the report states.
This means that if a house in Tirana costs 10 million lek, the taxation will be for the difference remaining after deducting the maximum value, which is 8.4 million lek.
So 10 million lek - 8.4 million lek = 1,600,0000. The building tax will be calculated on the difference, after the maximum threshold has been deducted according to the tax rate to be approved.
Moreover, families that own a second home will be charged with the tax, as according to the formula proposed by the Ministry of Finance, there will be no deduction for non-taxable value.
The new draft brings a division of 7 categories of municipalities, along with the maximum discount that will be applied to those municipalities, from the 4 categories that were previously proposed.
The previous draft proposed in 2023, provided in its article 8 a deduction from the value of the first residence of all individuals, in an amount equal to 50% of the value of the first residence, but in any case, no more than the maximum deduction threshold determined for 4 categories of municipalities. In Tirana, the maximum deductible threshold was proposed to be 4.5 million lek.
How will tax rates change?
The newly proposed draft, by the Ministry of Finance, published for public consultation, proposes a doubling of the tax level for apartments and an increase of up to 25% for commercial buildings.

Ndërsa për ndërtesat që përdoren për aktivitet tregtar aktualisht shkalla e taksës është 0.2% e vlerës së dyqanit. Drafti propozon rritje me 25% të shkallës maksimale të taksës, konkretisht propozohet që shkalla të variojë nga 0,15% deri në 0,25%.
Në të dyja rastet shkalla e taksës do të miratohen nga Këshillat Bashkiak brenda kufirit te miratuar nga qeveria.
Edhe në projektligjin e mëparshëm, i publikuar për konsultim publik në vitin 2023, parashikoj që për ndërtesat rezidenciale niveli i taksës të luhatej në vlerat nga 0,1% në 0,2% nga 0,05 që aktualisht zbatohet. Për ndërtesat tregtare u propozua nivel takse nga 0,15% në 0,25% nga 0.2% që është aktualisht dhe për ndërtesat bujqësore dhe industriale, u propozua një nivel takse 0,15% në 0,25%.
Kategoritë që përjashtohen
Ashtu si në 2023 ku edhe draft propozon përjashtim nga taksa e poasurive të paluajtshme për një sërë kategorish, si:
a) Pasuritë e paluajtshme shtetërore;
b) Pasuritë e paluajtshme fetare;
c) Ndërtesat e papërfunduara, që në 31 dhjetor të vitit, para vitit tatimor, janë duke u ndërtuar në përputhje dhe brenda afatit të ndërtimit, të përcaktuar në lejen e ndërtimit;
ç) Strukturat akomoduese, “Hotel/Resort me katër dhe pesë yje, status special”, sipas përcaktimit në legjislacionin e fushës së turizmit, që janë mbajtës të një marke tregtare të regjistruar dhe njohur ndërkombëtarisht “brand name”, së bashku me parcelën, pjesën takuese të parcelës ku ndodhet struktura akomoduese ose pjesën takuese të sipërfaqeve të përbashkëta në bashkëpronësi apo bashkë-posedim të detyrueshëm, në rastet kur struktura akomoduese është pjesë e një ndërtimi kolektiv. Përjashtimi i parashikuar për strukturat akomoduese zbatohet për një periudhë 10 (dhjetë)-vjeçare, dhe efektet e tij nisin nga viti i fillimit të veprimtarisë ekonomike të strukturës akomoduese, por në çdo rast, jo më vonë se 3 (tre) vjet nga viti kur është përfituar statusi special;
d) Banesat e deklaruara si vendbanim, në pronësi ose posedim të kryefamiljarëve, kur këta të fundit trajtohen me ndihmë ekonomike;
dh) Banesat e deklaruara si vendbanim, në pronësi ose posedim të kryefamiljarëve që përfitojnë vetëm pension pleqërie, pension invaliditeti apo pension social, kur familja e tyre përbëhet vetëm nga pensionistë, ose dhe me persona në ngarkim të tyre, që janë të paaftë për punë;
e) Banesat sociale në pronësinë e pushtetit vendor, si dhe banesat në pronësinë e pushtetit qendror dhe personave privatë, që në bazë të marrëveshjeve me Bashkitë, përdoren si banesa sociale;
ë) Immovable property owned by diplomatic and consular missions, used exclusively for the exercise of their official activities. The exemption applies only in cases where the relevant state provides diplomatic and consular missions of the Republic of Albania with equal treatment, in accordance with international agreements in force;
f) Linear infrastructure according to the definition given in Article 3 of the draft law;
g) Any immovable property for which exemption from immovable property tax is provided under the provisions of other laws in force./ Monitor
