Session in KPK, prosecutor Rrudha opposes the negative balance for an apartment

The prosecutor of Durrës, Teuta Rrudha, faced the Independent Qualification Commission, KPK on Tuesday, October 17, when during the hearing she gave explanations about the burden of proof for the property, disputing the negative balances found, as well as the findings in the professional criteria. She received positive reviews for the purity of the image.

The transitional re-evaluation process for prosecutor Rrudha is being carried out by the KPK body headed by Brunilda Bekteshi, with rapporteur Lulzim Hamitaj and member Etleda Çiftjan. Gerrit Sprenger was present as an international observer.

Teuta Rrudha started her career in the justice system in 1992 as a prosecutor in the Prosecutor's Office of Fier. In 2004, she moved to Durrës, where she currently works.

The Commission ascertains the financial inability of prosecutor Rrudha to pay part of the price of an apartment with an area of ​​130 m2 declared in 2009 that it was purchased against the price of 71,500 euros. A loan in the amount of 4.5 million ALL, a loan of 10 thousand euros and a gift of 10 thousand euros from the subject's brother, from the sale of a property of the family of origin, have been declared as sources of creation of this wealth.

Hamitaj noted that the investigation found that there was another contract for this apartment from 2008, where it was noted that the first installment in the amount of 15 thousand euros was liquidated.

The subject has stated that he has repaid 15 thousand euros and 4.5 million lek from the price of the apartment. According to her, it was an obligation in the amount of ALL 1.6 million, as it was stipulated in the contract that it should be settled after the initial registration of the property, which has not happened yet.

But, according to Hamitaj, from the mandates administered, it was found that about 35 thousand Euros and 4.5 million Lek were paid for the apartment, which in total reach the figure of about 9.6 million Lek. "Consequently, there should not have been an obligation to society," said Hamitaj.

KPK has considered as expenditure in 2008 the amount of 15 thousand euros determined as paid for the first installment in the contract of that year. The financial analysis resulted in a negative balance in the amount of 1.7 million ALL for the payment in 2008.

From the financial analysis carried out for the liquidation of the installments of this property, a total negative balance in the amount of about 3 million ALL has resulted.

Prosecutor Rrudha insisted during the hearing that she had not made a payment in 2008, as stipulated in the contract of that year. She explained that that contract was imposed by the bank's terms of obtaining a loan.

E pyetur nga Sprenger për një mandat pagese të vitit 2008, subjekti tha se nuk kishte pasur dijeni më parë për këtë rrethanë dhe se e kishte mësuar gjatë hetimit administrativ. Ajo tha se nuk dinte se kush mund ta kishte vendosur atë mandat pagese mes dokumenteve.

Rrudha u shpreh se nëse do të kryhej përllogaritja mes vlerës së partamentit dhe pagesave të kryera, ato do të dilnin të njëjta.

“Në vitin 2008 nuk është bërë asnjë pagesë dhe shënimi është bërë në mirëbesim me shoqërinë. Nuk kam asnjë pamundësi financiare në vitin 2008 pasi nuk kam bërë asnjë pagesë”, këmbënguli subjekti.

KPK nuk ka gjetur problem as në lejen e një automjeti në vitin 2015 për çmimin 4500 euro, me burim të ardhurat nga shitja e një apartamenti në Fier.

Hamitaj tha se nga analiza financiare paraprake për të ardhurat, investimet dhe shpenzimet për gjithë periudhën e rivlerësimit ka rezultuar bilanc negativ në shumën rreth 2.3 milionë lekë.

Rrudha i pranoi pasaktësitë lidhur me mosdeklarimin e pasurive të trashëguara, port ha se ishte pa faj pasi nuk kishte pasur dijeni për zotërimin pjesës takuese, si dhe nuk ishte e shoqëruar me mungesë burimesh. Sipas subjektit, bazuar në këto rrethana, pasaktësitë nuk mund të sillnin pasoja.

Regarding the decision of the court to overturn the decision not to start with the argument that the criminal offense was time-barred, the subject clarified that he had not continued the appeal, but had immediately registered the criminal proceedings and that the investigations are continuing. She added that the whistleblower had also complained to the High Inspectorate of Justice regarding this matter, which was archived.

The subject was also asked about an article in an online media where she was mentioned about her position on the case known as "file 339", where the results of wiretapping linked high officials of the Socialist Party to a group suspected of drug trafficking, involved in electoral campaign and voter buying and intimidation.

Rrudha said that "file 339" belonged to the former Prosecutor's Office for Serious Crimes. She explained in the hearing that she had registered criminal proceedings against two people for possession of weapons without a permit, concluding with the dismissal of the charge against one of the investigated and that she had requested a guilty plea for the other.

In conclusion, prosecutor Rrudha stated that she had reached a reliable level in all three re-evaluation criteria and asked for confirmation in office. KPK at the end of the session stated that it will announce in the following days about the progress of the process for the prosecutor Teuta Rrudha.
