The charges against Dako and the other 10 defendants were cleared

SPAK has disclosed the violations that burden the former mayor of Durrës, Vangjush Dako, and the other 10 defendants.

NOTICE OF SHORTAGE

The Special Prosecutor's Office against Corruption and Organized Crime has completed the investigations for criminal proceedings no. 197/2020, which refers to the criminal offenses "Forgery of seals, stamps and forms" and "Abuse of duty" and provided for by articles 190 and 248 of the Criminal Code.

The object of the investigation, in the framework of this proceeding, were two criminal facts: the procedure of granting the construction permit of a multi-storey building and the completion of its documentation up to the registration of the property, as well as the procurement procedure "Consultancy service" for securing the project. Project implementation for the Coastal Promenade and the public beach from Bërryli to Currila", with a limited fund of 21,000,000 Lek including VAT.

At the end of the preliminary investigations of this proceeding, it was found that:

First, during the approval and clarification/recording of the construction permit, approved by the decision of the Council of Territorial Regulation at the Durrës Municipality No. 02 dated September 28, 2011, in favor of the Company "Fakle sh.pk", actions were carried out in opposition to the powers of the Mayor and officials of the Directorate of Planning and Territory Control, provided by Law No. 8652, dated July 31, 2000 "On the organization and functioning of local government" and Law No. 10 119 dated April 23, 2009 "On territorial planning" and the by-laws issued in its implementation, which consist of the protocol/clarification of the construction permit on October 14, 2014, two years after the construction was completed and the residents lived in the building in words.

After disclosing the construction permit, all the documents compiled and administered by the construction entity and the officials of the Directorate of Planning and Territorial Control were drawn up in a fictitious manner, drawing up the relevant documents for all the phases in which the construction took place, while it has been proven with evidence such as questioning of witnesses and relevant expertise, that the construction of the building was completed in 2012 and was habitable.

In this way, the legalization of a multi-storey building, built without permission, while the construction itself was not done according to the project presented by the builder and approved by the Durrës Municipality.

Secondly, in relation to the second investigated fact, it turned out that in 2014 the Municipality of Durrës carried out a procurement procedure, for consulting services, the provision of a project called "Implementation design for the Coastal Promenade and the public beach from Bërryli to Currila" .

Me Urdhrin Nr. 84 datë 11 Shtator 2013 protokolluar me Nr. 4151 Prot., në të njëjtën datë, është ngritur komisioni për caktimin e specifikimeve teknike. Ky grup është ngarkuar me detyrën për të përgatitur: detyrën e projektimit, fondin limit, termat e referencës si dhe te gjitha specifikimet teknike për këtë procedure prokurimi.

Nga ana e anëtarëve të Komisionit të ngritur nga Kryetari i Bashkisë Durrës, i pandehuri Vangjush Dako, janë kryer gabim llogaritjet e fondit limit, me një vlerë gati dhjetë herë më shumë se ajo që duhet të llogaritej në bazë të Vendimit të Këshillit të Ministrave, Nr. 444 datë 05 Shtator 1994 “Për tarifat e studimit, projektimit, drejtimit dhe kolaudimit të veprave të ndërtimit”. Kryetari i Bashkisë Durrës, i pandehuri Vangjush Dako ka nxjerrë urdhrin e prokurimit pikërisht me vlerën e llogaritur nga Komisioni, ndërkohë që pasi është lidhur kontrata duke u nisur dhe nga përmbajtja e saj, është bërë pagesa vetëm për 60% të vlerës totale.

Edhe pas bërjes me dije nga ana e Kontrollit të Lartë të Shtetit, në Akt Kontrollin përkatës të Muajit Qershor 2015, në lidhje me gabimin e bërë nga Komisioni dhe nga Titullari i Autoritetit Kontraktor, duke lënë rekomandim që të rikuperohet dëmi ekonomik i shkaktuar deri në atë fazë, Bashkia Durrës dhe administrata përkatëse ka vijuar me pagesën e këstit të dytë prej 40% të vlerës totale të kontratës në muajin Dhjetor 2015, ndërkohë që e gjitha vlera e paguar më tepër prej 18.318.400,2 lekë, është pasqyruar në pasqyrat financiare të Bashkisë Durrës, si një dëm ekonomik dhe detyrim që shoqëria përfituese i ka kësaj Bashkie prej vitit 2016 e në vijim.

Në përfundim të hetimeve paraprake Prokuroria e Posaçme ka paraqitur në Gjykatën e Posaçme të Shkallës së Parë për Korrupsionin dhe Krimin e Organizuar, kërkesën për dërgimin në gjyq të çështjes penale në ngarkim të të pandehurve si më poshtë:

1-Vangjush Dako, me detyrë ish Kryetar i Bashkisë Durrës, i akuzuar për kryerjen e veprës penale të “Shpërdorimit të detyrës”, e kryer në bashkëpunim parashikuar nga nenet 248 dhe 25 i Kodit Penal, e kryer dy herë;

2-Adhurim Qehajaj, me detyrë ish Drejtor i Drejtorisë së Planifikimit, Kontrollit dhe Zhvillimit të Territorit në Bashkinë Durrës, i akuzuar për kryerjen e veprave penale të “Falsifikimit të vulave, stampave e formularëve”, e kryer në formën e falsifikimit të formularëve të miratuar, nga personi që ka për detyrë hartimin e tyre dhe në bashkëpunim, si dhe veprën penale të “Shpërdorimit të detyrës”, e kryer dy herë dhe në bashkëpunim, parashikuar nga nenet 190/3 dhe 25 dhe 248 dhe 25 të Kodit Penal;

3-Fiqiri Farruku, administrator i subjektit “Fakle” sh.p.k, i akuzuar për kryerjen e veprës penale të “Falsifikimit të vulave, stampave e formularëve”, e kryer në formën e falsifikimit të formularëve të miratuar, nga personi që ka për detyrë hartimin e tyre dhe në bashkëpunim, parashikuar nga nenet 190/3 dhe 25 të Kodit Penal;

4-Ermal Lama, with specialist duties in the Directorate of Planning, Control and Development of the Territory in the Municipality of Durrës, accused of committing the criminal offense of "Forgery of seals, stamps and forms", committed in the form of forgery of forms approved, by the person tasked with drafting them and in collaboration, provided by articles 190/3 and 25 of the Criminal Code;

5-Fatmir Ejupi, with specialist duties in the Directorate of Planning, Control and Development of the Territory in the Municipality of Durrës, accused of committing the criminal offense of "Forgery of seals, stamps and forms", committed in the form of forgery of approved forms , by the person tasked with drafting them and in collaboration, provided by articles 190/3 and 25 of the Criminal Code;

6-Adrian Bulku, licensed topographical engineer, contracted by "Fakle" sh.pk, accused of committing the criminal offense of "Forgery of seals, stamps and forms", committed in the form of forgery of forms approved, by the person tasked with drafting them and in collaboration, provided by articles 190/3 and 25 of the Criminal Code;

7-Ferzilet Hajdëri, with the duty of Ing. Licensed Construction, in the role of the inspector of the building built by "Fakle" sh.pk, accused of committing the criminal offense of "Abuse of duty", provided by article 248 of the Criminal Code;

8-Adnand Toçila, with specialist duties in the Projects Office in the Municipality of Durrës, accused of committing the criminal offense of "Abuse of duty", provided for by Article 248 of the Criminal Code;

9-Diana Dedja, with specialist duty in the Office of Projects in the Municipality of Durrës, accused of committing the criminal offense of "Abuse of duty", provided for by Article 248 of the Criminal Code;

10-Bashkim Salillari, with specialist duties in the Projects Office in the Durrës Municipality, accused of committing the criminal offense of "Abuse of duty", provided for by Article 248 of the Criminal Code;

11-Hanza Reka, in charge of the Finance Sector in the Municipality of Durrës, accused of committing the criminal offense of "Abuse of duty", provided for by Article 248 of the Criminal Code.

In addition to sending the criminal case against the defendants mentioned above for trial, the Special Prosecutor's Office requested the dismissal of the criminal proceedings against the person under investigation, Meri Priftuli, after the evidence recently administered by the investigation proved that this citizen has not participated in the commission of any criminal offense.
