The Constitutional Court rejected the request of Jamarbër Malltez for the annulment of some decisions of the GJKKO, the Court of Appeal and the Criminal Panel of the Supreme Court. The reason was the failure to form the necessary decision-making majority of 5 judges.

On 05.12.2024, the Constitutional Court (Court) took into consideration the case with petitioner Jamarbër Malltezi, with the object of annulment of decisions no. 112, dated 20.10.2023 and no. 116, dated 23.10.2023 of the Special Court of First Instance for Corruption and Organized Crime; no. 56, dated 21.11.2023 of the Court of Appeal for Corruption and Organized Crime; no. 00-2024-384, dated 05.03.2024 of the Criminal College of the Supreme Court, as incompatible with the Constitution of the Republic of Albania.
At the conclusion of the examination of the case, the Court, based on Article 73, point 4, of Law No. 8577, dated 10.02.2000 “On the Organization and Functioning of the Constitutional Court”, as amended, decided to dismiss the request, due to the failure to form the necessary decision-making majority of 5 judges.
