"Innovative project": SPAK reveals the connection between the Minister of Defense and the duo Zoto-Mërtiri

In the summer of 2014, the Water-Sewage company in Korça owned by the city municipality presented a "technological innovation". The city's Wastewater Plant was equipped with photovoltaic panels, which were promised to cover the costs of the plant's electricity.

The photovoltaic plant was built in a few months between 2013-2014 and was licensed by ERE in November 2014, as the first solar energy producer in the country. It cost the taxpayers of Korça almost 2 million euros, together with the interest on the loan.

A decade later, the investigation of the Special Prosecutor's Office against the fugitive former deputy prime minister, Arben Ahmetaj, sheds light on the fact that the "innovative project" was proposed by the pair of fugitive businessmen, Mirel Mërtiri and Klodian Zoto, and was won by them. uncontested, after paying for a 3-day trip to Italy for local Socialist Party officials.

Part of the trip were the then mayor of Korça, Niko Peleshi, today the Minister of Defense and the director of the Korça Waterworks, Petrit Tare. The group was joined in Italy by Arben Ahmetaj - at that time the deputy of the Socialist Party for the area of ​​Devolli.

The trip to Italy took place on April 11-14, 2013 and according to SPAK, the plane tickets, hotel stay and travel expenses were paid by the Mertiri-Zoto duo.

SPAK also found some photos on Zoto's computer, where in one of them, Peleshi, Ahmetaj, Tare and the Italian citizen, Francesco Pistritto appear smiling alongside Mërtir and Zoto in the Pantheon building in Rome.

In his testimony for SPAK, the Minister of Defense, Niko Peleshi, said that he had not made payments for the plane ticket and hotel stay, as he had been invited by UKKO Korçë and assumed that "the payments were made by this company".

But the testimony of Peleš contradicts that of Taras, who affirmed in his testimony that Klodian Zoto had paid for his plane ticket and for the hotel "he had not paid anything".

During their business with the socialist officials, Mërtiri and Zoto have paid dozens of travel expenses and stay in luxury hotels - which in Ahmetaj's case has been assessed as an illegal benefit in the form of bribery by the Special Prosecutor's Office.

Minister Peleshi and the administrator of the Korça Waterworks, Petrit Tare, were not available for comment until the publication of this article.

Expensive plans

The photovoltaic plant was not the first project of Mërtir and Zoto with the Waterworks of Korça. In February 2013, the company "Integrated Technology Services" registered in the name of Zoto concluded a commercial agreement with the director of UKKO, Petrit Tare, for the installation of 22 thousand electronic water meters with a total value of 3 million and 376 thousand euros.

Të dhënat nga dëshmitë dhe hetimet e prokurorisë tregojnë se biletat për udhëtimin e funskionarëve publikë në Romë dhe makina me qira që u përdor atje u paguan nga Klodian Zoto, që në këtë kohë ishte administratori, aksioneri dhe punonjësi i vetëm i shoqërisë FMO.

Në dëshmitë e tyre, Peleshi dhe Tare thonë se udhëtuan për të parë nga afër punë të ngjashme për te hequr dyshimet.

“Në atë kohë impiantet fotovoltaike nuk ekzistonin në Shqipëri ndërkohë që sot është bërë e zakonshme ndaj dhe kishte shumë pyetje,”, citohet në dëshmi Peleshi, tani ministër i Mbrojtjes.

Pas vizitës dyshimet u ‘fashitën' dhe biznesi shkoi mirë. Tre muaj pas udhëtimit në Romë, më 9 korrik 2013, kompania FMO i paraqiti UKKO-së një plan investimi me kosto 1.9 milonë euro.

Të nesërmen më 10 korrik, kompania bëri ndryshime në propozim duke zëvendësuar Zoton me Arenc Myrtezanin, i cili ia kishte blerë aksionet më 1 korrik 2013 për 100 mijë lekë. Po të njëjtën ditë, Këshilli Mbikqyrës i Ujësjellës Kanalizime e miratoi projektin dhe  një muaj më vonë propozimi kaloi edhe në Këshillin Bashkiak.

Impianti u bë funksional në qershor 2014 dhe në nëntor të po këtij viti, Enti Rregullator i Energjisë i miratoi licencën për prodhim të energjisë.

Por prokuroria gjeti pas hetimeve se kalimi pa pengesa i projektit fshihte një sërë manovrash që duket se u kanë rënduar taksapaguesve. Nga ekspertimi i kompjuterit të Zotos, prokuroria gjeti një sërë shkresash të pafirmosura që më pas miratoheshin nga funksionarët publikë.

Të vetmet pikëpyetje u ngritën nga Ministria e Energjitikës, por nuk duket se u morën në konsideratë.

“Në dokumentacionin që keni dërguar, keni sqaruar që projekti, finacimi dhe zbatimi i projektit do të bëhen sipas ofertës së Kompanisë Italiane FMO. A është marrë në konsideratë ndonjë ofertë alternative, e cila mund të rezultojë më e mirë nga pikëpamja ekonomike?”, citohet një email i zyrtarëve të Ministrisë së Energjitikës së kohës.

Hetimet tregojnë se palët e përfshira jo vetëm që nuk kërkuan oferta më të mira ekonomike, por pranuan ofertën e FMO, që siç rezulton nga hetimi ishte 600 mijë euro më e lartë se kostoja për ndërtimin e impiantit.

Bazuar në dokumentet e gjetura në kompjuterin që iu sekuestrua Klodian Zotos, del se kompania FMO kishte nënshkruar një kontratë për të ndërtuar impiantin me kompaninë italiane “Futura”.

“Sipas kësaj kontrate rezulton se FMO sh.p.k. pasqyrohet sikur është kontraktor i përgjithshëm i një Photovoltaik Poëer Plan e zotëruar nga UKKO, e vendosur në një zonë prej rreth 22 000 m2 e ndodhur në Korçë. Shoqëria Futura, do të marrë përsipër implementimin, ndërtimin, e impiantit fotovoltaik që do të ndërtohet në Korçë, kundrejt vlerës 1,150,000 Euro”, thuhet në dosjen hetimore.

Nga ana tjetër, FMO i kërkoi UKKO-së një çmim prej 1 750 000 euro pa TVSH. Madje, UKKO ishte vetë edhe garante për financimin, pasi për këtë mori një kredi nga Veneto Bank, konsulent për të cilën ishte shtetasi italian Francesco Pistritto.

“Pagesat do të realizohen nga UKKO sh.a. me një interes prej jo më shumë se 3.7% në vit. UKKO do të paguajë shumën neto pa tvsh 1 993 474 euro”, citohet kontrata përfundimtare nga prokuroria.

Hetimet zbuluan se pas gjithë kësaj historie, kompania FMO deklaroi për përdorim të brendshëm fitime të barabarta me diferencën mes ofertës së italianëve të “Futura” dhe çmimit që ata i ngarkuan UKKO-së.

Në dy emaile që iu gjetën Zotos në lidhje me këtë projekt, ai shënon fillimisht arkëtimin e 24.2 milionë lekëve dhe në një dokument të dytë 52.8 milionë lekë.

“Zoto nga posta e tij elektronike [email protected] i ka dërguar vetes së tij (dërguesi dhe marrësi i emailit është i njëjtë) dokumentin e emërtuar “Pershendetje Stela.docx” në formatin ëord dhe dokumentin e emërtuar “Budget 2015.xlsx” në formatin excel, nga ku rezulton se paraqiten ndër të tjera edhe të ardhurat që priten të arkëtohen për vitin 2015 nga situacionet për këtë projekt, që janë në vlerën 24,220,000 lekë. Shpenzime nuk ka, kështu që fitimi i parashikuar është po në vlerën 24,220.000 lekë,” thuhet në dokumentin e prokurorisë.

Dëshmi kontradiktore

Prokuroria thotë në arsyetimin e saj mbi provat e mbledhura se planet për projektin u vunë në lëvizje pas udhëtimit në Itali.

“Përsa më sipër, konkludohet se udhëtimi i kryer në drejtim të shtetit Italian, takimi në këtë të fundit të shtetasve Mirel Mërtiri, Francesco Pistritto, Klodian Zoto, Petrit Tare, Niko Peleshi, në muajin prill 2013, është kryer para se të paraqitej oferta dhe të lidhej kontrata,” thuhet në dosje.

I pyetur në SPAK, ministri i Mbrojtjes Niko Peleshi citohet të ketë thënë se ishte përfshirë në këtë udhëtim nga Tare për shkak të skepticizmit mbi këtë “projekt të ri, novativ, të padëgjuar”. Ai ka shtuar se si kryebashkiak, nuk kishte autoritet mbi ujësjellësin, por e lidhte me këtë projekt interesi “që të mos dështonte, pasi ishte një shërbim publik dhe shumë delikat”.

Peleshi thotë se impiantin e vizitoi vetëm në vitin 2019 dhe se atëherë i ishte prezantuar si sukses.  Ai shtoi gjithashtu se nuk kishte dijeni se kush i pagoi faturat e udhëtimit dhe pretendon se udhëtoi i ftuar nga drejtori i UKKO-së, Tare dhe se prezumoi që ky i kishte paguar biletat.

Peleshi also added in his testimony that he had known Zoto and Mërtir through Ahmetaj and that he connected his presence in Italy for this case with the fact that he was Devolli's deputy. Peleshi even justifies his former colleague in the government and says that he "Arbeni has not presented any interest in relation to the project, for which we had gone to see its implementation".

Unlike Peleshi, the director of UKKO Korçë, Petrit Tare admitted to SPAK that Zoto had paid for his plane ticket, while for Peleshi he said that "I don't remember". Tare then says that he didn't even pay for the food. "Regarding the payment of the dinner, I can clarify that I did not pay anything", he was quoted before the prosecutor.

Tare has also admitted that he was aware of the project before the FMO company made an official proposal to UKKO, and for that reason they also visited Italy to "make sure of the company's capacity".

According to the Prosecution's investigation, Ahmetaj was quite involved in the projects of the two businessmen and often required reporting from them.

"On 27.09.2012 at 16.11.10 Mireli writes to Arben: I just broke up with the director of Korça. Everything went well. When we meet we talk. Greetings. 16.13.02: They look good. When we meet, we'll talk", the prosecution quotes a conversation that seems to be related to the project for the plant.

Ahmetaj himself denied the business with Mërtir and Zoto in his testimony before escaping from justice. But the photos found on Zoto's computer and the various trips on the same days, refute the former deputy prime minister on the run. Pistritto himself, in his testimony, admits to having an old acquaintance with Ahmetaj, but claims that the meetings were accidental. The prosecution says that both lied.

"In fact, as can be easily ascertained, both statements, in addition to contradicting each other, contain untrue circumstances because from the above-mentioned photographs and other administered evidence, it is clear that these persons were in the company of each other and third parties , in the conversations held for the photovoltaic project of UKKO Korçë", it is stated in the prosecution document./ BIRN
