:35 falsifications and violations in the file", Malltezi: The investigation

In a detailed testimony in the second part of the 'Pasvon' podcast, Jamarbër Malltezi has presented a series of accusations against the Special Structure Against Corruption and Organized Crime (SPAK).

Malltezi has stated that the main reason that prompted him to turn his personal battle into a book with an ISBN serial number was precisely the need to clearly document these abuses, so that law students would have a manual on how the rule of law can be misused.

According to him, the prosecutors in this case have committed at least 35 forgeries, acts for which, in a normal legal state, any prosecutor would have been immediately considered a defendant.

Malltezi explains that prosecutors have thrown into the trash the official notebooks of the Albanian state from 1942-1943, which unequivocally certified the correspondence and rejection of his great-grandfather towards the Italians, preferring to send investigators who did not even know Italian to research in vain over 13 thousand archival sheets in Italy. This, according to him, confirms the tendency to ignore clear official evidence in favor of creating a false narrative.

Malltezi stated that SPAK has implemented direct political orders, citing the dates of April 9 and May 7, 2022, when Prime Minister Edi Rama from the Socialist Party assembly and congress openly criticized the justice institutions for inaction against former Prime Minister Sali Berisha.

According to him, public statements by foreign diplomats such as Yuri Kim and Gabriel Escobar also added to the same line of pressure. R

The result was a deep and absurd investigation that targeted the individual instead of the criminal offense. To illustrate this difference between the Western and Eastern schools of justice, Malltezi emphasizes that while in the West the criminal offense is investigated to find the culprit, in Eastern dictatorships the individual was first targeted and then the crimes were sought or fabricated.

"They have demanded an accounting from Social Security by handing over the personal numbers of Sali Berisha's children and grandchildren from 1995 onwards, before some of them were even born," he declared indignantly.

Another essential element that stands out is the involvement of judges and high-ranking institutions in concealing the truth.

Malltezi illustrated this through a specific case involving the High Judicial Council (HJC) and Judge Irena Gjoka.

According to him, within an interval of only 20 days, the same Secretary General of the Supreme Court of Justice initially provided the defense lawyers with the official document confirming the dismissal of Judge Gjoka in 1996, and then, standing before parliamentary committees, openly lied to opposition MPs that the institution did not have that document.
