SP MPs await with criticism the government's draft for online betting

The Albanian government targeted the illegal gambling market through Operation End of the Madness in 2013, and in 2015, passed a law that was described as radical to curb the industry.

However, gambling flourished even more after the adoption of the new law, which prompted the government to impose a complete ban on them in the fall of 2018.

Five years later, the government claims to put this sector back on the legal track through a draft law that was presented on Wednesday to the parliamentary committee for Economy and Finance by the Deputy Minister of Finance, Vasilika Vjero.

According to Vjeros, the draft was consulted with interest groups and sports federations and guaranteed that the revenue from the licensing of this activity would go to support the sport.

"One of the innovations of the draft law is the creation of a special fund, which will be used to support sports, culture and innovation projects," said Vjero.

But her arguments were not convincing for the deputies.

The project faced numerous criticisms and questions from the ruling majority MPs about the consultation process, the manner and value of the company tax, etc. Meanwhile, opposition MPs accused the government of failing to reform the ban on gambling and that the new law posed a money-laundering risk.

SP MP Erion Braçe said that the law had not been consulted with all the interested groups and asked to hear the association of people injured by betting, as well as AKSHI, about how online betting would be controlled.

"This commission has the obligation to both demand accountability and provide a solution that does not lead back to the bandits," Braçe said, predicting that "this activity will also turn into a battle between those who are legal and those who are illegal." .

Democratic MP Jorida Tabaku said that the law affected several other important laws such as the one on the national lottery, on banks and the Financial Supervision Authority.

"It is the potential risk of money laundering," said Tabaku, adding that it also risks competition since the criteria for the entities that apply are limited.

Edhe Edmond Spaho e quajti të rrezikshëm hapjen e basteve online, pasi sipas tij ky aktivitet është i lidhur direkt me pastrimin e parave dhe shteti nuk e kontrollon dot.

“Fakti që pranohet se ky aktivitet ka vazhduar ilegalisht, tregon që s'ka kapacitete,” tha ai.

Deputetët socialistë, Alban Xhelili dhe Pranvera Resulaj kërkuan që drafti i qeverisë të rishkruhej dhe ngritën shqetësime për normën e tatimit mbi kompanitë.

Xhelili ngriti pikëpyetje mbi formulën e përllogaritjes të të ardhurave, e cila është shumë e lartë se ajo që ishte kur bastet ishin të ligjshme dhe paguanin taksa. “Të ardhurat bruto për një vit janë përllogaritur në masën 6,5 miliardë.  Pyetja është a mendoni se do trefishohen bastexhinjtë?” tha ai.

Po ashtu, ai tha se 95 për qind të vlerës totale të basteve e lozin të paligjshmit dhe projektiligji nuk sqaron se si do të futen në sistemin e ligjshëm.

“Duke patur parasysh që bastet do jenë online, pagesa jo cash, identifikim personi, regjistrim lojtari, a mendoni që këta që lozin 95 për qind të vlerës do na vijnë dhe do na lozin te kjo e ligjshmja?  pyeti ai përfaqësuesen e qeverisë.

“Shpresoj të jem i gabuar, por besoj se me bastet online do t'i gjeni tabletat me 1 softuer të ligjshëm dhe 10 të paligjshëm, që s'do t'i kapë dot askush,” shtoi Xhelili.

Deputetja Resulaj e cilësoi të ulët shkallën tatimore prej 15 për qind e të ardhurave bruto nga loja dhe kërkoi një barrë më të lartë fiskale për kompanitë e basteve.

Në fund të mbledhjes, deputeti Braçe kërkoi nga Ministria e Financave që të sjellë në Kuvend një listë për kompanitë që zotërojnë sot kazinotë, xhirot e tyre dhe tatimet e paguara.

“Në ligjin që kemi bërë, atë në fuqi, kemi thënë që do licencohen kazino vetëm në hotele me 5 yje brand name dhe resorte, e kështu me radhë. Do ishte mirë që të kemi një listë për transparencë dhe të mos kemi aludime,” tha Braçe.
