Former Supreme Court member acquitted of asset concealment

The Special Court of First Instance decided on Monday, July 7, the acquittal of the former member of the Supreme Court on the charge of concealing assets – a case filed by SPAK about three years ago. In October 2022, the Special Prosecution Office sent the case against Selimi for trial for the criminal offense of “Refusal to declare, failure to declare, concealment or false declaration of assets, private interests of elected persons and public servants or of any other person who has a legal obligation to declare”.

According to SPAK, which was represented in this case by prosecutor Doloreza Musabelliu, the investigation revealed data indicating that Selimi had unjustified real estate assets with legal sources. For this reason, the seizure was requested and imposed on several assets in his possession: ½ of a plot of land with an area of ​​432 m² and a 132.25 m² building, a fuel point, located on the “Lungomare” promenade in Vlora; a plot of land with an area of ​​2,400 m² in Jonufër, as well as another plot of land with a gas point on the “Transbalkan Road”, also in Vlora.

The trial of this case took about two and a half years, under the rules of ordinary trial. During the hearings, two expert reports on the former judge's assets were debated, among other things, one of which showed a positive balance and the other a negative balance. The financial analysis previously conducted by the Independent Qualification Commission for Selimi was considered by SPAK to be unrelated to the criminal process.

However, at the end of the trial, Judge Rudina Palloj ruled that the defendant Shkëlzen Selimi was not guilty of concealing assets, on the grounds that the criminal fact alleged was not proven to exist.

Shkëlzen Selimi worked for two decades in the justice system before being dismissed in 2018 by vetting for concealing contacts with people involved in organized crime. His wife, former Administrative Appeals Judge Rilinda Selimi, was also dismissed from the College due to inappropriate contacts, although the majority of the panel found no problems with her assets.
