18 families of a 7-story building in Fier have a mortgage certificate for their property, but the Cadastre does not issue them with a certificate of ownership.

Since 1992, these residents have become owners of these apartments and to this day they have not been provided with a certificate of ownership, in response they are told that it does not exist on paper. After 30 years and with the intervention of Fiksi, the institutions were set in motion.

Fiks Fare traveled to Fier, on Andon Doro Street, at the request of 18 families living in a 7-story building, built after the 1990s in Fier. They say they bought the apartments with regular notarial contracts, paid the amount to the owner-builder, but to this day, after 30 years, they have not received the certificates.

"We go to the Cadastre and they tell us that there is no building. Where do we live, in the air? says one resident. Others add that they have done documents to legalize and certify it, but so far there has been no progress. "We have all the documents, from the notary to the permit. How did that builder do it then? The contracts also include the permits that the builder obtained. They say there are no papers. They have taken us to other notaries, we have made payments and no action has been taken," add the residents. They even unanimously say that when this building does not exist, how do they bill us for water, electricity or other taxes.

Together with a representative of the residents, Iljaz Rizvani, the Fiks Fare group went to the Fier Cadastre, where the residents have been dozens of times. The director does not wait for them, while other employees claim that "he is very busy". Fiksi makes a written request, asking how it is possible that there is no document for this building, when the residents have all the documentation and why their property is not registered?

In its response, the Cadastre writes that the properties of the entities in question have not been registered for years because the builder has not registered the construction permit, a process that would make it possible to subsequently register the property according to the agreements made between the builder and the beneficiaries. Regarding the mortgage certificate that you mention, the Cadastre writes in its response, from the verifications carried out, the residents are not found to have one, meanwhile we clarify that this is a cadastral act that proves the existence of a relationship between the parties, which in this case is not sufficient, based on the legislation in force, to be provided with a Certificate of Ownership. Therefore, the act of acquiring ownership according to Article 193 of the Civil Code is missing. In response to Fiksi's question about what documents or actions these residents must take to obtain the Certificate of Ownership, the Cadastre explains:

To assist the process, the Local Directorate of ASHK Fier has initiated a procedure to clarify the legal situation of the building and has forwarded a request for the provision of technical-legal documentation if a building permit has been issued by the Municipality, the District Council and the construction entity. Also, the Local Directorate of ASHK Fier is nearing completion of the on-site identification process, a process that is important to clarify each property of each owner.

Finally, the Cadastre adds that the administrative procedure will continue and the ASHK will take measures to handle the case in accordance with the provisions of the Council of Ministers No. 1180/2020 "On the determination of special legalization procedures in favor of the possessors of the building with violations of the construction permit, as well as the rules for the completion of the procedure by entities and/or construction companies or investors".

After this interest, Fiksi learned that the Fier Cadastre has once again received the residents' requests, acts have been drawn up by engineers for the stability of the building, a building administrator has been appointed, and now the file is ready to be completed and the residents will be given ownership certificates after more than 30 years.
