SPAK demands the rejection of 23 of Beqaj's requests, former minister:

The court hearing against former Minister of Health, Ilir Beqaj, was accompanied by strong debates between the defense and the Special Prosecution Office. SPAK requested that the court dismiss all 23 requests submitted by Beqaj, calling them unfounded in law, while the former minister accused the prosecution of violating procedural rights and abusing its powers.

Special Prosecutor Edvin Kondili argued that Beqaj's claims were addressed earlier during the investigation and in the preliminary hearing. According to SPAK, the request for the invalidity of the indictment notice does not stand, as every procedural action was approved by the preliminary judge.

The prosecution also rejected the claim that the lack of the original procurement contract renders the case invalid, explaining that there is a unified copy in the Compulsory Health Insurance Fund, which is considered valid evidence. SPAK also defended the legality of the evidence obtained from the electronic control of computer equipment.

On the other hand, Beqaj reacted harshly to the prosecution's position, stating that his rights were violated during the investigations and that this is preventing him from exercising his defense effectively.

"The prosecution admitted that during the investigation phase it openly violated my rights. Today I find it difficult to defend myself. Prosecutors have gained independence with the Justice Reform, but they are using it to violate procedural rights and do whatever they want," the former minister said in the courtroom.

Beqaj also questioned the validity of the criminal complaint against him, claiming that it was based on assumptions and not on concrete facts. He also requested that the court force SPAK to prove that the forensic laboratory and the equipment used for examining electronic data are certified according to standards.

After hearing the parties, the panel decided not to immediately rule on the former minister's requests. The next hearing is scheduled for September 11, when the court's decision on the 23 requests submitted by Beqaj is also expected.
