Elbasan-Leka Road, DP: The lowest bids were disqualified, economic damage 21 million euros

The Democratic Party has denounced the procedures developed by the Albanian Road Authority related to the Elbasan-Lekaj project.

The spokesperson for the Anti-Corruption Unit in the Democratic Party, Genta Vangjeli, stated that as part of Corridor VIII with a total limit value of around 150 million euros, the winners for this road axis were predetermined.

DECLARATION:

Following our denunciation of the 6 procedures developed by the Albanian Road Authority related to the Elbasan-Lekaj project, part of Corridor VIII with a total limit value of approximately 150 million euros, the winners were announced as follows:

“Construction of the Elbasan – Paperr road axis Phase I” (3.5km)

The winner is operator S….. shpk with a value of 20 million euros excluding VAT or about 80% of the limit value, with a difference of 3.5 million euros more than the lowest price offer.

“Construction of the Elbasan – Paperr road axis Phase II” (3 km)

The winner is operator G…….. shpk with a value of 18 million euros excluding VAT or about 72% of the limit value, with a difference of 500 thousand euros from the lowest price offer.

“Construction of the Elbasan – Paperr road axis Phase III” (2.4 km)

The winner is operator 2 T… shpk, also owned by the brother of the former head of the Guard “Sako”, with a value of 22 million euros excluding VAT or about 89% of the limit value, with a difference of 4.6 million euros more than the offer with the lowest price.

BOE Winner A….C………… shpk & A…….. C………….. shpk& A……. K……….. shpk, with a value of 20 million euros excluding VAT or 83% of the limit value, with a difference of 4.2 million euros more than the lowest price offer.

“Construction of the Paperr – Grykshit Bridge road axis, Phase II” (3 km)

Winner BOE “B….. shpk & B…….H…….. shpk & E…… shpk & R…………..” with a value of 21 million euros excluding VAT or 86% of the limit value, with a difference of 3.9 million euros more than the lowest price offer

“Construction of the Paperr – Grykshit Bridge road axis, Phase III” (3.25km)

The winner is operator A……B……………..shpk with a value of 21 million euros excluding VAT or about 85% of the limit value, with a difference of 4.1 million euros more than the lowest price offer.

Violations:

In each case, the lowest bids were disqualified, causing an economic damage of 21 million euros;

All operators declared winners are currently invested in parallel contracts in violation of DT Annex 8, Part II, Point “D”, and DCM No. 42, dated 16.01.2008 “On the approval of the regulation on the criteria and procedures for granting professional licenses for the implementation, classification and discipline of legal entities that exercise construction activities” as amended;

b) Entities licensed in implementation cannot qualify as winners for public works procured under the public procurement law if they are winners and/or have in process at the same time as a contractor/subcontractor an investment under a contract concluded/or in the process of being concluded.

As we stated, no foreign operator participated due to insufficient time for the equivalence of licenses.    

How many times do we have to denounce the ARRA for legal violations committed repeatedly and arrogantly, so that special prosecutors or not, open the files and begin investigations?

These procedures will cost 21 million euros more than the amount with which they could be implemented.

Who is responsible for these millions stolen from citizens' taxes?
