Fund of 100 million ALL, Opposition councilors appeal the decision on changes and additions to the budget for Shkodra

The councilors of the opposition have submitted to the prefecture, the appeal regarding "For the approval of the 2023 budget and the final mid-term budget program 2023-2025 of Shkodër Municipality".

The councilors headed by Majlinda Angoni, Prefect of the Shkodër District, state that this project-decision before being reviewed by the Municipal Council, had to be consulted with the public, an obligation that is defined in articles 18 and 54 letters dh, e, of law no. 139/2015 "On local self-government" as well as Article 51 i.

They also expressed that the Presidency of the Council takes a decision to pass the draft act to the public consultation process, while the President of the Council passes the draft act to the Permanent Committee that covers the field of relevant activity, for planning and carrying out the public consultation, determining the relevant deadlines for the realization of the process.

Dear Ms. Majlinda Angoni, Prefect of Shkodër District.

 On 13/09/2023, Wednesday, at 17:00, a meeting of the Shkodër Municipal Council was held, with an agenda attached to this complaint. The agenda provided for consideration of several draft decisions, among them the draft decision "On an amendment to VKB no. 71, dated 27.12.2022 "On the approval of the 2023 budget and the final medium-term budget program 2023-2025 of Shkodër municipality", of amended. This decision was approved by a majority of votes, but there are some legal violations, which we first presented in the council's minutes and in the meeting of 13.09.2023, we present them below:

 Së pari, ky projekt-vendim para se të shqyrtohej nga Këshilli Bashkiak, duhej të kalonte për konsultim me publikun, detyrim qe pëcaktohet ne nenet 18 e 54 germa dh, e, te ligjit nr. 139/2015 "Për vetëqeverisjen vendore" si dhe neni 51 i

 Rregullores për organizimin dhe funksionimin e Këshillit Bashkiak Shkoder. Sipas udhezimit te Rregullores për konsultim me publikun, Kryetari i Këshillit, në konsultim me Sekretarin e Këshillit, i paraqet Kryesisë së Këshillit propozimin për kalim në konsultim publik të projekt-aktit, kur ky i fundit klasifikohet si i tillë.

 2. Kryesia e Këshillit merr vendim për kalim të projekt-aktit në proces konsultimi publik.

3. Kryetari i Këshillit i kalon projekt-aktin Komisionit të Përhershëm që mbulon

 fushën e veprimtarisë përkatëse, për planifikimin dhe realizimin e konsultimit publik, duke përcaktuar afatet përkatëse të realizimit të procesit.

4. Komisioni i Përhershëm shqyrton projekt-aktin dhe përgatit:

 o Kalendarin e Konsultimit Publik o Njoftimin e Konsultimit Publik

 o Organizimin dhe drejtimin e takimeve publike. o Cakton detyra për Sekretarin për njoftimin, organizimin dhe mbarëvajtjen

 procesit.

 5. Sekretari i Këshillit (Sekretariati) asiston Komisionin në procesin e planifikimit dhe realizimit të konsultimit publik.

 Bazuar tek Regullorja për Konsultimin Publik dhe mardhëdhenien me mediat, Njoftimi i Konsultimit Publik publikohet:

 - Ne faqen ëeb të bashkisë Regjistrin elektronik të konsultimit publik - Në mediat sociale zyrtare të Këshillit;

 - Ju dërgohet grupeve të interesit nëpërmjet postës elektronike;

 - Nëpërmjet mediave lokale (nëse ka të tilla). - Duke e publikuar në gazetat vendore (nëse ka të tilla).

 - Nëpërmjet një lajmërim publik, i cili afishohet në mjedise publike në qëndër, lagje, njësi administrative, qëndër fshati, nëpërmjet ndërlidhësit komunitar në lagjet e qytetit apo kryetarët e fshatrave, në rastet kur takimet bëhen në lagje apo fshat;

 Gjatë konsultimit publik të realizuar nëpërmjet një takimi publik të cdo lloj forme, regullorja parashikon mbajtjen dhe bërjen publike të procesverbalit të  takimit.

 Qytetarëve u jepet kohë e mjaftueshme për të dërguar rekomandimet dhe mendimet e tyre në lidhje me cështjen që konsultohet.

 Në zbatim të Regullores "Për konsultimin publik dhe marrëdhenien me median", përmbledhja e rekomandimeve:

 I dergohet Kryetarit të Bashkisë për opinion; I vihet në dispozicion Komisionit të Përhershëm të Këshillit  duhet të trajtojë projekt- vendimin.

 I dërgohet me postë elektronike çdo këshilltari Bëhet publike në faqen e internetit të Këshillit /Regjistrin Elektronik

 Pas dërgimit të përmbledhjes së rekomandimeve të grumbulluara gjatë procesit të konsultimit publik Kryetarit të Bashkisë, koordinimi midis Këshillit dhe Kryetarit përbën një element kye në suksesin e procesit.

 Në rastin konkret, perderisa ligji kerkon konsultim me publikun, duhej të hiqej nga rendi i dites dhe te zbatohej procedura ligjore per kosultim me publikun.

Një pjesë e këtij fondi shkon për:

 - Blerje e pajisjeve të Teknologjisë së Informacionit dhe Komunikimit: kompjutera, laptop-ë, printera, aparate fotografike, dron, videokamera. Fondi total 10 milion lekë.

 The total number for each device that needs to be purchased new is not known or determined. We do not know how many computers, laptops, printers, video cameras, drones and cameras the Municipality will buy with the 100 million fund.

 There is no reference price, how much does each of the devices to be purchased cost?! How much does 1 computer, 1 laptop, 1 printer, 1 camera, 1 drone, 1 video camera cost?

 The above, based on Law No. 107/2016 dated 27.10.2016 "On the District Prefect" article 16 point 2 letter "b", (i), in Law No. 139/2015 "On local self-government", article 8 points 1 and 2, article 9, point 1 letter "b" and point 2, return for reconsideration, the Decision of the Shkoder Municipality Council "On the approval of the 2023 budget and the final mid-term budget program 2023-2025 of the Shkoder Municipality, amended.
