Venice Opinion, Mediu: Parliament cannot prevent the case from being referred to the Constitutional Court
The head of the PR, Fatmir Mediu, said that the Assembly cannot prevent the sending of issues to the Constitutional Court when this is requested by 1/10 of the members of Parliament.
"According to the logic of the Socialist Party, the Assembly, with a majority vote, can block any initiative that 1/10 of the members of Parliament can address to the Constitutional Court. In this regard, what is the need for the Constitutional Court when the Assembly can block the sending of any act?" said Mediu, invited to News24, discussing Olta Xhaçka's mandate and the opinion published today by the Venice Commission.
He said that the MP is free to vote, he can vote according to his convictions, but he cannot vote against the Constitution.
"The Constitution of Albania states that the decisions of the Constitutional Court are mandatory to implement," Mediu said.
