The Rector of the University of Shkodra resigns: Interference and violation of university autonomy

The Rector of the University of Shkodra "Luigj Gurakuqi", Tonin Gjuraj, has irrevocably resigned from his position, arguing that the decision comes after, according to him, interventions by the Board of Administration that violate university autonomy and conflict with the legal framework.

In his letter to the Minister of Education, Gjuraj emphasizes that the rector's mandate must be based on transparency, public accountability, and respect for the academic institution, while warning that the current situation has made it difficult to exercise his leadership function normally.

Guraj's letter:

Dear Madam Minister,

I am writing to you to reaffirm a fundamental principle that guides the way I understand and exercise the task entrusted to me, as well as the institutional responsibility that flows from it. This principle must remain clear and unchanging in every circumstance related to the functioning and management of the university.

The task of rector of the University of Shkodra "Luigj Gurakuqi" was entrusted to me through a process of competition and academic voting. The mandate originates from the university community and, on this basis of legitimacy, the management of this public institution is supported.

The candidacy for this position was not a step to conclude a personal career, already long consolidated in other institutions of higher education and diplomacy. On the contrary, the acceptance of this function is linked to the conviction that the University of Shkodra “Luigj Gurakuqi” deserves a genuine process of institutional transformation, based on transparency, public accountability and respect for university autonomy, in accordance with the important role that this institution occupies in the higher education system in Albania.

The duty of the rector is neither a personal mission nor a mechanism of imposition, but an institutional function, which requires partnership and support for strengthening academic quality, improving infrastructural conditions and affirming the university in its rightful role in the public life and intellectual development of the city of Shkodra and beyond. This is a responsibility, honor and obligation to the tradition of this institution and this city, but, above all, to the parents and students who entrust this university with their formation and future.

From the beginning of my term of office, I have emphasized that the university must remain free from any political influence. The rector does not represent political interests, but serves the academic community and the public. In this sense, any institutional support, including that of the Ministry of Education and the Municipality of Shkodra, which, in fact, have not been lacking, has been and remains welcome, as long as it respects this principle and contributes to the development of the university.

Në këtë frymë, kam kërkuar mbështetje për përpjekjet e nisura dhe jo krijimin e barrierave artificiale, që pengojnë një proces transformimi të domosdoshëm për universitetin dhe rolin që ai duhet të ketë në jetën e qytetit.

Kjo qasje, mesa duket, nuk gjeti mirëkuptimin e duhur dhe nëse ushtrimi i këtij funksioni shoqërohet me ndërhyrje që cenojnë autonominë institucionale, atëherë nuk po hezitoj të lë në tavolinë dorëheqjen time dhe t’i rikthehem jetës akademike si profesor.  Rektori është i përkohshëm, Bordi i Administrimit (BA) i jashtëkohshëm, por Universiteti i Shkodrës “Luigj Gurakuqi” është dhe mbetet i përhershëm.

Vendimi i BA-së për emërimin e administratorit është, sipas meje, i papranueshëm dhe një qëndrim të tillë, siç dihet, unë e kam bërë publik.  Por, kjo thellohet më tej, kur, po ky Bord, pa bazë ligjore, në mënyrë të njëanshme dhe diskriminuese në raport me stafin tjetër akademik e administrativ, merr vendimin për t’i shtyrë moshën e daljes në pension.

Përveç kësaj, BA, përfshirë dhe 4 përfaqësuesit e MA në të, injoron dhe hedh poshtë me arrogancë, Raportin Final të Grupit të Punës të ngritur prej jush, pas kërkesës time, për verifikimin e ligjshmërisë së procedurave të konkursit publik për rekrutimin e personelit administrative, në vitin 2025, në Universitetin e Shkodrës “Luigj Gurakuqi”.  Ky Raport i jep të drejtë pretendimeve të rektorit, ku konkludon qartë se: “shpallja për punësim nga BA është e pavlefshme”.  Vendimi i BA, nr. 2015, datë 15. 07. 2025 “Për miratimin e kritereve për procedurat e rekrutimit të stafit në varësi të administratorit”, është në kundërshtim me ligjin nr. 80/2015, dhe si i tillë është nul dhe nuk duhet të sjellë pasoja juridike.

Bordi i Administrimit vijon shkeljet ligjore, duke paguar honorare projektesh në mënyrë preferenciale, pa vendime Bordi, por direkt nëpërmjet administratorit, pa filtër shkencor dhe të pacertifikuar nga drejtoria përkatëse dhe rektori, siç ka qenë dhe është praktika normale.

Sa sipër, unë kam autoritetin dhe të drejtën, por jo forcën për të kundërshtuar më tej BA, kurse ata, të gjithë së bashku, kanë forcën, por jo autoritetin dhe të drejtën për t’u imponuar.

Mandati që buron nga komuniteti universitar nuk është vetëm një e drejtë për të drejtuar, por një detyrim për ta ushtruar atë me integritet, në respekt të autonomisë universitare dhe në shërbim të universitetit e qytetit të Shkodrës.

Lutem, zj. Ministre, t’i referoheni nenit 39 të Ligjit 80/2015, pika 9, për të garantuar vijimin normal të funksionimit të Universitetit të Shkodrës “Luigj Gurakuqi”, pas dorëheqjes time të parevokueshme, në dobi të studentëve dhe komunitetit akademik.

I humbly express my deepest gratitude and deepest condolences to and for the citizens of Shkodra, the parents of the students, the academic staff, the administration, and the students, especially those who supported my project of updating tradition, promoting transparency, and initiating institutional transformation, which, although with various barriers and difficulties, had just begun to show its first fruits.
