Albania failed with the quality of laws, has the most bloated government

The process of drafting laws in Albania has weaknesses as it is done without proper analysis of the effects they have on the economy and society, a recent study by SIGMA (a joint EU and OECD initiative for Support for Governance Improvement and Management) found.

Foreign experts point out that Albania has the most bloated government cabinets in the region, but this large advisory force is not translating into higher-quality laws and better reporting of results.

According to published data on the quality of Regulatory Impact Assessment (RIA) implementation among SIGMA-9 governments, Albania performs poorly.

According to SIGMA, the reports accompanying Albanian draft laws fail at the most critical points, as they do not provide a complete analysis of the problem, do not examine alternative options other than what the government proposes, and do not identify the interest groups that are affected.

More worrying is the lack of financial calculations (cost-benefit) for the impact of laws, a criterion where Albania, along with almost all countries in the region, except Serbia which has made partial progress, completely fails. The only point where Albania shows a sign of reflection is in the analysis of monitoring and evaluation, but even this remains at minimal levels.

This weakness in policy design is also reflected in the planning and reporting phase of ministry work. Line ministries fail to build work plans with measurable objectives, making accountability for public money an impossible mission.

SIGMA's findings suggest that Albania's challenge is the inability to direct the large human resources in cabinets towards serious regulatory analysis and monitoring of results.

The following table accompanying the study shows an alarming situation for the transparency and effectiveness of public policies. In the 8 main pillars of the assessment, Albania has received a partial passing grade in only one of them: "monitoring and evaluation after the implementation of policies."

Montenegro leads the process, fulfilling almost all the criteria required by international standards. Serbia also shows a consistent performance, especially in cost analysis and implementation monitoring.
