4.2 million euros for Kanye West, DP reports Rama and Gonxha to SPAK

The Democratic Party parliamentary group has filed a complaint with the Special Prosecution Office (SPAK) against Prime Minister Edi Rama and Blendi Goxha, regarding the 4.2 million euro financing of the event to which artist Kanye West was invited.

The report is related to suspicions of committing the criminal offenses of "abuse of office" and "violation of equality of participants in tenders or public auctions", committed in collaboration.

In its announcement, the Democratic Party emphasizes that public funds used to finance the activity were administered in violation of the law and requests from SPAK to verify the responsibilities of the reported persons.

The report comes after public debates regarding the amount of 4.2 million euros allocated for the organization of the event with the participation of Kanye West, with the opposition demanding clarifications on the procedures followed and the use of public funds.

SPAK is expected to evaluate the material filed and decide whether to launch an investigation into the allegations raised in the report.

"The Parliamentary Group of the Democratic Party, represented by the Chairman of the Parliamentary Group Mr. Gazment Bardhi, has today filed a criminal complaint with SPAK against Prime Minister Edi Rama and Minister Blendi Gonxhja, for the criminal offenses of "Abuse of office" and "Violation of equality of participants in public tenders or auctions", for the proposal and approval of the financing of 4.2 million euros for a private event of singer Kanye West. 

With Normative Act No. 3, dated 06.07.2026, upon the proposal of the Minister of Tourism, Culture and Sports, citizen Blendi Gonxhja, the Council of Ministers has decided to partially finance the organization and progress of a cultural-artistic activity, with an impact on the promotion of tourism and the image of the Republic of Albania, the concert of the renowned international artist, Kanye West (YE), to be held in Tirana, on July 11, 2026, in the amount of 400,000,000 Lekë or 4.2 million Euros.

Gjatë arsyetimit të nevojës, në relacion thuhet se në rastin konkret nevoja identifikohet së pari në planin praktik me faktin që organizimi i këtij eventi kërkon mbështetjen prej 400 000 000 (katërqind milionë) lekësh, pa të cilën evenimenti/koncerti rrezikon të dështojë, bazuar në komunikimet e zhvilluara mes përfaqësuesve të Ministrisë së Turizmit, Kulturës dhe Sportit dhe organizatorëve të koncertit dhe së dyti në planin juridik, për shkak të faktit se në legjislacioni në fuqi nuk ka një bazë ligjore, një dispozitë autorizuese ligjore, për nxjerrjen e një akti nënligjor, që të lejojë dhënien e një mbështetjeje të tillë, në kushte të tilla për një eveniment muzikor/artistik/kulturor me efekt të theksuar turistik. Theksojmë se qoftë sipas ligjit nr. 10 352, datë 18.11.2010, «Për artin dhe kulturën», të ndryshuar, qoftë sipas ligjit nr. 93/2015, «Për turizmin», të ndryshuar, është e pamundur të miratohet akt nënligjor për mbështetjen e këtij evenimenti në kushtet konkrete.

Në kallëzimin penal të depozituar nga grupi parlamentar i PD theksohet se “kuadri ligjor në fuqi ka sanksionuar detyrimin e autoriteteve shtetërore që, në ushtrimin e kompetencave dhe përgjegjësive të tyre, të përdorin me eficencë dhe efektivtet burimet financiare shtetërore, duke respektuar parimet e qëndrueshmërisë së financave publike, barazisë para ligjit dhe konkurrencës së lirë.

Në këtë drejtim, Kushtetuta, Marrëveshja e Stabilizim-Asociimit, ashtu si dhe ligjet e dala në zbatim të tyre, kanë sanksionuar ndalimin e çdo sjellje apo veprimi të institucioneve shtetërore, të cilat cënojnë në vetvete Buxhetin e Shtetit, lirinë e pjesëmarrjes dhe barazinë e palëve në ofrimin e mallrave dhe shërbimeve, pavarësisht nëse përdoren ose jo për qëllime publike.

Rezulton se mbi bazën e një operatori ekonomik privat, shtetasi Blendi Gonxhja, me detyrë Ministër i Turizmit, Kulturës dhe Sportit ka iniciuar procedurën për miratimin e aktit normativ, me qëllim që këtij operatori t’i akordohej një fond prej 4.2 milionë Euro, duke shfrytëzuar fondin rezervë të Buxhetit të Shtetit. Ky i fundit, referuar dispozitave ligjore të mësipërme, mund të përdoret vetëm për shpenzime të cilat nuk njihen dhe janë të pamundura të parashikohen, siç mund të jenë rastet e fatkeqësive natyrore, përmbytjeve, tërmeteve, epidemive dhe emergjencave civile.

Në rastin konkret, nuk jemi përpara asnjërit prej këtyre rasteve, pasi koncerti muzikor ishte një ngjarje e planifikuar në kohë, dhe operatori ekonomik privat kishte mundësi që të aplikonte me përpara për të përfituar një fond të caktuar për realizimin e këtij aktiviteti, në përputhje me procedurat ligjore.

By doing so, citizens Edi Rama and Blendi Gonxhja, on the one hand, have violated the reserve fund, which constitutes one of the main groups of expenditures of the State Budget, as well as violated the principles of free competition and non-discrimination, since such an opportunity was not foreseen for other economic operators, who could also apply to receive financial support for the realization of this concert or similar ones.

"From the above, it is clear that citizen Edi Rama, acting Prime Minister of Albania, and citizen Blendi Gonxhja, acting Minister of Tourism, Culture and Sports, in collaboration with each other, have acted contrary to the law regarding the use of the reserve fund to support a private musical activity, harming the legitimate interests of the state, and in this sense their actions fulfill the element of the objective side of the criminal offense of "Abuse of office", provided for by Article 248 of the Criminal Code.

On the other hand, both of these citizens, in collaboration with each other, have violated the rules regarding the freedom of participation and the realization of equality of citizens in public tenders, with the aim of creating unfair advantages and privileges for a certain economic operator, thus fulfilling the element of the objective side of the criminal offense of "Violation of equality of participants in public tenders or auctions", provided for in Article 258 of the Criminal Code." - states the report filed with SPAK.
