Renowned lawyer Ledio Braho commented for Politiko.al on the Constitutional Court's decision to suspend President Bajram Begaj's decree, which provided for the holding of partial elections in the Municipality of Tirana.

Explaining the legal aspects of the decision, Braho said that today's decision only concerns the suspension of the decree for Tirana, while the conclusion of the case will come on October 31, when the Constitutional Court is expected to review Erion Veliaj's request for the annulment of the decision of the Council of Ministers that dismissed him from office as mayor.
" Today's decision only concerned the suspension for Tirana.

Given that the fundamental decision will be made on October 31, regarding Veliaj's request, consequently the elections for the municipality of Tirana cannot be held on November 9 as has been determined for the other 5 municipalities because there is no time.

"The moment Veliaj's request is rejected on October 31, there is no time to set deadlines for the 9th for campaigning, for registering entities or candidates... " Braho said on Politiko.al.

Braho explains that the elections for the Municipality of Tirana will be postponed in any case. 

" In any case, the Tirana elections, even if Veliaj's request for the Council of Ministers that dismissed him is rejected, will be postponed."

So, on November 9, elections will be held for the other 5 municipalities, while for the Municipality of Tirana, depending on the decision of the Constitutional Court, either another date will be set, or no date will be set until it is sentenced by a final court decision, if it is to be sentenced ," Braho concluded.

This development has opened a new debate on election deadlines and institutional balances between the President and the Constitutional Court, while the final decision on October 31 is awaited with interest./ Politiko.al/
