52-year-old British citizen sentenced to 2 years in prison for building hotel

The Saranda Court has sentenced a 52-year-old Albanian man with British citizenship to 2 years in prison after being found guilty of illegally building a hotel in Ksamil.

The decision was issued on June 24 by Judge Entiljano Spahiu, at the end of a court process that lasted about three years. Although the case was reviewed with a summary trial, the investigations were returned for completion, prolonging the proceedings.

According to the file, on May 16, 2023, the police found that an unauthorized building was being built in neighborhood no. 2 of Ksamil. The work was carried out by Gazmir Mediu, who was arrested in flagrante delicto, but was later released by court order.

However, an expert examination conducted about a year and a half later revealed that construction had not only not stopped, but had been completed and put into operation as a hotel. Expert verifications and analysis of satellite images showed that the facility had expanded significantly, going from an area of ​​39 square meters in 2022 to a completed and functional structure in 2024.

According to the court, the organization of the building with a reception, a lobby, five accommodation rooms, auxiliary facilities and parking, as well as its functioning as a hotel structure, proved that the construction was carried out for profit purposes and not for family use.

For these reasons, the 52-year-old was initially sentenced to 3 years in prison for the criminal offense of "Illegal Construction". Due to the summary trial, his sentence was reduced by a third, ultimately set at 2 years in prison.

The decision is not yet final. The fate of the execution of the sentence will depend on the review by the Court of Appeal, as the defendant has been tried so far while at large.
