Three independent documents, a citizen monitoring, an analysis of official air quality data, and a state audit, lead to the same conclusion: citizens' exposure to pollution is high and continuous, while the institution that should prevent it, the National Environment Agency, is not exercising the basic functions for which it exists.
The consequence is not only environmental, but also institutional: legal standards exist, but their implementation remains, as the state audit itself describes, largely formal.
In December last year, at the SM2 monitoring station on Kavaja Street in Tirana, the concentration of PM2.5 particles reached 75 micrograms per cubic meter, fifteen times above the World Health Organization guideline limit of 5 μg/m3. In the same month, PM10 reached 86.5 μg/m3. This was not the only case: in the months of August–November of the same year, the same station recorded values between 7 and 11 μg/m3.
The same applies to noise, which in public discourse is often treated as a secondary problem compared to air, but which the alternative monitoring report documents as equally structural. Of the 300 monitored points in Tirana, 78 percent exceed the guideline standard of 55 decibels during the day, and about half of the city does not reach the minimum level of quiet at night, with some stations, such as TR272, at 71 decibels, remaining practically uninhabitable for a healthy sleep according to international medical criteria.
A national trend, not just Tirana
Official data from the National Environment Agency, analyzed in the report conducted by Qëndresa Këytare, confirm that this is not just a local story about a Tirana street. The national average of PM2.5 has almost doubled between 2019 and 2024, from around 10 to over 16 μg/m3, while nitrogen dioxide (NO2), the indicator most closely linked to urban traffic, has increased from 19.11 to 25.45 μg/m3 in the same period. PM10 peaked at μg/m3 in 2023, before falling slightly in 2024. These figures remain formally below the annual limits of the European Union, but move in the opposite direction to what would be expected from a country that declares continuous approximation to European environmental standards.
Elbasani është rasti më i qartë ku kjo tendencë kalon nga shqetësuese në të paligjshme: në 2024, PM2.5 në qytet arriti 30.15 μg/m3, mbi kufirin vjetor ligjor të BE-së prej 25 μg/m3. Pjesa tjetër e treguesve, NO2, dioksidi i squfurit, ozoni, benzene, mbetën brenda standardeve, gjë që izolon grimcat e imëta si burimin kryesor të rrezikut lokal dhe hap pyetjen se cilat aktivitete specifike po e shkaktojnë atë. Korça dhe Durrësi, ndërkohë, shfaqin rritje të vazhdueshme të ozonit në nivel troposferik që prej 2023-shit, një formë tjetër ndotjeje, e lidhur me reaksione fotokimike vere, që rrezikon të kalojë pa u vënë re nëse vëmendja publike mbetet e përqendruar vetëm te grimcat dimërore.
Sistemi që mat pak dhe mat keq
Ajo që lidh të dy raportet e monitorimit është një dobësi e përbashkët: Shqipëria nuk e njeh me saktësi shtrirjen e problemit që përshkruan. Rrjeti zyrtar i Agjencisë Kombëtare të Mjedisit ka vetëm shtatë stacione automatike matjeje në të gjithë territorin, disa prej të cilave, sipas raporteve të vazhdueshme të Komisionit Evropian për Kapitullin 27 të negociatave të pranimit, nuk funksionojnë rregullisht për shkak të mungesës së fondeve për mirëmbajtje. Vetë të dhënat zyrtare e tradhtojnë këtë boshllëk: disa qytete dhe vite raportojnë vlera prej 0 μg/m3 për disa ndotës, një shifër që në praktikë tregon jo ajër të pastër, por instrumente jashtë funksionimi.
Kjo mungesë mbulimi krijon një hendek që organizatat e shoqërisë civile po përpiqen ta mbushin. Rrjeti i monitorimit alternativ i GreenAL dhe Co-PLAN është zgjeruar nga 13 pika fillestare në Unazën e Vogël të Tiranës në mbi 800 pika ajri e zhurme dhe 40 pika uji në gjashtë bashki të mëdha gjatë 2025-ës. Milieukontakt, në një krahasim të pavarur në Durrës për 2023-shin, regjistroi mesatare PM2.5 prej 25.28 μg/m3, më shumë se dyfishi i mesatares zyrtare prej 12.24 μg/m3 për të njëjtin qytet e periudhë.
Raporti mbi cilësinë e ajrit e cilëson me kujdes këtë diferencë: monitorimet alternative “nuk kundërshtojnë domosdoshmërisht të dhënat zyrtare, por i plotësojnë ato duke identifikuar hotspot-e”, një formulim diplomatik për një realitet të thjeshtë, që rrjeti shtetëror i matjes nuk po e kap pjesën më të rëndë të ekspozimit qytetar.
Deri këtu, historia do të mund të lexohej si një dështim teknik: pak stacione, buxhet i pamjaftueshëm, monitorim i fragmentuar. Auditimi i plotë i përputhshmërisë që Kontrolli i Lartë i Shtetit ka kryer mbi veprimtarinë e Agjencisë Kombëtare të Mjedisit tregon diçka më të thellë, se vetë institucioni përgjegjës për lejet, vlerësimet e ndikimit dhe inspektimet mjedisore nuk po e ushtron këtë rol as edhe në pjesën që nuk kërkon fonde shtesë, por thjesht respektim procedurash.
KLSH dokumenton raste konkrete ku leje mjedisore tip A dhe B janë miratuar pa vlerësim paraprak të ndikimit në mjedis (VNM), edhe pse ligji e kërkon këtë hap për projekte me rrezik të lartë: një subjekt prodhues pajisjesh elektrike, një minierë në Bulqizë, një fabrikë prodhimi birre, një karrierë guri gëlqeror. Në raste të tjera, lejet janë dhënë pa kontrata për depozitimin e mbetjeve, pa raporte për mbrojtjen nga zjarri apo pa dokumentacionin e konsultimit publik të kërkuar me ligj, siç ndodhi me një subjekt ku procesverbali pohonte se ishte zhvilluar një dëgjesë publike, ndërkohë që formulari përkatës mungonte plotësisht në dosje. Në një rast tjetër, një leje tip B hyri në fuqi përmes një mekanizmi “miratimi në heshtje”, pa asnjë akt firmosur nga ministria, praktikë që vetë auditi e cilëson në kundërshtim të drejtpërdrejtë me ligjin nr. 10448.
Dimensioni financiar i këtij dështimi është po aq domethënës sa ai rregullator. Për shkak të mosrakordimit mes drejtorive të lejeve, monitorimit dhe financës brenda vetë agjencisë, tarifat vjetore që subjektet e licencuara duhet të paguajnë nuk janë planifikuar si të ardhura buxhetore për 2020 dhe 2021, duke krijuar një diferencë prej 13.04 milionë lekësh. Paralelisht, 840 subjekte kanë detyrime të papaguara prej 8.52 milionë lekësh, të grumbulluara që nga 2015-a deri në qershor 2020, pa asnjë listë të identifikuar debitorësh.
Baza e të dhënave mbi lejet aktive përmban 1,274 leje në format të vjetër dhe 590 vlerësime apo deklarata mjedisore, shumë prej të cilave mbeten formalisht në fuqi edhe kur subjekti është pezulluar në Qendrën Kombëtare të Biznesit, ose edhe kur për të njëjtin instalim është lëshuar më pas një leje e re, pa u revokuar zyrtarisht ajo e vjetër.
Po aq shqetësuese është ana e zbatimit të sanksioneve. Kur inspektorët e Agjencisë kanë vendosur gjoba deri në 1 milion lekë për shkelje të verifikuara, shkarkime ujërash të ndotur, mosdorëzim mbetjesh, komisioni i apelimit i ka shfuqizuar disa prej tyre, duke pranuar në vendim se shkeljet ekzistonin, por pa dhënë një arsyetim të fortë ligjor për anulimin e masës.
Nuk ka ende një listë publike të 840 subjekteve debitore ndaj Agjencisë Kombëtare të Mjedisit, as një vlerësim të pavarur shëndetësor që të lidhë drejtpërdrejt të dhënat e shtretërve spitalorë me hartën e ndotjes. Ministria e Turizmit dhe Mjedisit nuk i ishte përgjigjur, në kohën e auditimit, kërkesës së vetë Agjencisë për një bazë të dhënash të përbashkët mbi debitorët.
Ndërkohë, planet vjetore dhe mujore të inspektimit rezultojnë të pjesshme dhe pa asnjë analizë risku në përzgjedhjen e subjekteve që kontrollohen, çka do të thënë se sistemi nuk është i orientuar drejt atyre që shkaktojnë dëmin më të madh, por funksionon kryesisht në mënyrë rutinore.
Ligje evropiane, zbatim i pjesshëm
Albania has transposed most of the European legal framework for air and water quality: Directive 2008/50/EU, Law No. 10431/2011 “On the Protection of the Environment”, Law No. 162/2014 “On the Protection of Air Quality”, the National Air Quality Strategy of 2014 and the National Air Quality Management Plan of 2019. For recreational and drinking waters, VKM No. 797/2010 and VKM No. 379/2016 apply, comparable to the standards of the World Health Organization and FAO.
The problem, as one of the reports itself formulates, is not the lack of legislation, but the fact that “approaches to legislation… must be applicable in practice, so as not to lose the purpose for which they were created… and not remain simply printed on paper.”
The European Commission's annual reports on Chapter 27 have been repeating this observation consistently for years: insufficient monitoring network, data not in real time, strategies not yet fully implemented.
The consequences of this combination, high exposure plus poor surveillance, fall on citizens. Residents of neighborhoods along high-traffic corridors in Tirana live with noise levels above 60 decibels during the day and often above 45 at night, levels that are medically linked to sleep disorders and higher long-term cardiovascular risk. Children and the elderly, who are more sensitive to fine particles, are the most exposed group during winter episodes like the one on Kavaja Street.
In communities near mines or plants that have received permits without a full impact assessment, the environmental risk remains officially undocumented, and therefore invisible in national statistics. Businesses that follow full procedures, meanwhile, compete on an unequal playing field with those that receive permits with incomplete documentation or escape fines through appeal.
What the three reports jointly put on the table is a single, straightforward question: how much sense does it make to demand stricter implementation of environmental standards from citizens and businesses, when the legal institution responsible for administering these standards, from the first permits to the last fines, has not yet managed to establish order on its own database and on the collection of obligations that the law itself grants.
There is still no answer as to how the National Environment Agency, the Ministry of Tourism and Environment, and the main municipalities will now act on these findings, whether the recommendations of the Supreme State Audit will be followed, whether the decisions of the appeals committee will be reviewed, and whether the measurement network will be expanded beyond the seven existing stations. /ACQJ
