SPAK takes the file against Ervis Martinaj, 9 defendants for murder, assassination and criminal group to trial

The Special Prosecution Office against Corruption and Organized Crime has closed the investigations and sent for trial one of the most important organized crime files, where Ervis Martinaj is among the defendants.

According to the official announcement from SPAK, the case is related to several serious criminal events, including the murder of Gjin Ndoji (Borici), attempted assassinations, providing conditions for committing murders, illegal possession of weapons, participation in a structured criminal group, as well as accusations of active corruption against judicial officials.

 At the same time, SPAK announces that investigations continue for other suspected persons and other criminal episodes discovered during this proceeding.

The Special Prosecution Office Against Corruption and Organized Crime has completed the investigations and sent for trial, criminal proceeding no. 9/2 of 2023 against the defendants:

Ervis Martinaj, accused of committing the criminal offenses:
"Premeditated murder", to the detriment of the victim Gjin Ndoj (Borici), committed on 09.8.2020 in the city of Shkodra, in a special form of cooperation, that of a structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by a structured criminal group and criminal organization", provided for by articles 78/2, 28/4, 333/a/1 and 334 of the Criminal Code.

"Providing the conditions and material means to commit murder", to the detriment of citizen Kleant Musabelliu, committed in a special form of collaboration, that of a structured criminal group, "Structured criminal group" and "Participation in a structured criminal group", provided for by articles 80, 28/4, 333/a/1 and 334 of the Criminal Code.

"Illegal possession and production of weapons, explosive weapons and ammunition", in collaboration in the form of a "Structured Criminal Group", provided for by articles 278/1, 28/4, 333/a and 334 of the Criminal Code.

Denis Brajović, accused of committing the criminal offenses:
"Premeditated murder", to the detriment of the victim Gjin Ndoj (Borici), finalized on 09.08.2020 in the city of Shkodra, committed in a special form of cooperation, that of a structured criminal group, "Structured criminal group" and "Commitment of criminal offenses by a structured criminal group and criminal organization", and "Participation in a structured criminal group", "Unauthorized possession and production of weapons, explosive weapons and ammunition", in cooperation in the form of a "Structured criminal group", provided for by articles 78/2, 28/4, 333/a and 334 of the Criminal Code.

“Sigurimi i kushteve dhe i mjeteve materiale për të kryer vrasje”, në dëm të shtetasve Dorian Duli dhe Ibrahim Lici, kryer në formë të veçantë bashkëpunimi, atë të grupit të strukturuar kriminal, “Grup i strukturuar kriminal”, parashikuar nga nenet 80, 28/4, 333/a dhe 334 të  Kodit Penal.

“Pjesëmarrje në grup të strukturuar kriminal” , “Mbajtje pa leje dhe prodhimi i armëve, armëve shpërthyese dhe municionit”, në bashkëpunim në formën e “Grupit të strukturuar kriminal”, parashikuar nga nenet 278, 28/4, 333/a dhe 334 të  Kodit Penal.

Klaodor Hakaj, i akuzuar për kryerjen e veprave penale:
“Sigurimi i kushteve dhe i mjeteve materiale për të kryer vrasje”, në dëm të shtetasit Kleant Musabelliu, kryer në formë të veçantë bashkëpunimi, atë të grupit të strukturuar kriminal, “Grup i strukturuar kriminal” dhe “Pjesëmarrje në grup të strukturuar kriminal”, të parashikuara nga nenet 80, 28/4, 333/a/1 e 334 të Kodit Penal.

Prekë Kodra, i akuzuar për kryerjen e veprave penale:
“Sigurimi i kushteve dhe i mjeteve materiale për të kryer vrasje”, në dëm të shtetasve Dorian Duli dhe Ibrahim Lici, kryer në formë të veçantë bashkëpunimi, atë të grupit të strukturuar kriminal, “Grup i strukturuar kriminal” dhe “Pjesëmarrje në grup të strukturuar kriminal”, të parashikuara nga nenet 80, 28/4, 333/a/1 e 334 të Kodit Penal.

Aleks Ndreka, i akuzuar për kryerjen e veprave penale:
“Sigurimi i kushteve dhe i mjeteve materiale për të kryer vrasje”, në dëm të shtetasve Dorian Duli dhe Ibrahim Lici, kryer në formë të veçantë bashkëpunimi, atë të grupit të strukturuar kriminal, “Grup i strukturuar kriminal” dhe “Pjesëmarrje në grup të strukturuar kriminal”, të parashikuara nga nenet 80, 28/4, 333/a/1 e 334 të Kodit Penal.

Nuredin Dumani, i akuzuar për kryerjen e veprave penale:
“Sigurimi i kushteve dhe i mjeteve materiale për të kryer vrasje”, në dëm të shtetasve Dorian Duli dhe Ibrahim Lici, kryer në formë të veçantëbashkëpunimi, atë të grupit të strukturuar kriminal, “Grup i strukturuar kriminal” dhe “Pjesëmarrje në grup të strukturuar kriminal”, të parashikuara nga nenet 80, 28/4, 333/a/1 e 334 të Kodit Penal.

Eljon Hato, i akuzuar për kryerjen e veprave penale:
“Vrasje me paramendim” e mbetur në tentativë, e kryer në bashkëpunim në dëm të shtetasit Tauland Pepa, ndodhur me datë 21.2.2021 në qytetin e Shkodrës, parashikuar nga nenet 78, 22, 25, i Kodit Penal.

“Mbajtja pa leje dhe prodhimi i armëve, armëve shpërthyese dhe municionit”, në bashkëpunim, parashikuar nga nenet 278 dhe 25 të Kodit Penal.

“Korrupsion aktiv i gjyqtarit, prokurorit dhe i funksionarëve të tjerë të drejtësisë”, e kryer në bashkëpunim, parashikuar nga nenet 319 dhe 25 i Kodit Penal.

Arsad Bashli, accused of committing the criminal offenses:
"Premeditated murder" attempted, committed in collaboration to the detriment of citizen Taulant Pepa, occurring on 21.2.2021 in the city of Shkodra, provided for by articles 78, 22, 25, of the Criminal Code.

"Unauthorized possession and production of weapons, explosive weapons and ammunition", in collaboration, provided for by articles 278 and 25 of the Criminal Code.

"Active corruption of a judge, prosecutor and other justice officials", committed in collaboration, provided for by articles 319 and 25 of the Criminal Code.

Bardhyl Mavraj, accused of committing the criminal offenses: 
 "Active corruption of a judge, prosecutor and other justice officials", committed in collaboration, as provided for by articles 319 and 25 of the Criminal Code.

"Providing the conditions and material means to commit murder", to the detriment of citizens Dorian Duli, Ibrahim Lici, committed in a special form of collaboration, that of a structured criminal group, "Structured criminal group" and "Participation in a structured criminal group", provided for by articles 80, 28/4, 333/ae and 334 of the Criminal Code.

Meanwhile, for other possible accomplices in the commission of the above criminal offenses, as well as for other persons involved in criminal activities, which have resulted during the investigative actions carried out within the framework of this criminal proceeding, the separation of the criminal case has been decided, which continues to exist in the preliminary investigation phase.
